Timeline

I had filed for K1 visa and the CO in Nigeria refused my fiancée visa because according to him our age difference is too much (about 20 years) they want me to marry my fiancée and file a IR-1 / CR-1. Has anyone been in this situation before and what do you advice I do?

Timeline

It's common if you are an older woman petitioning a much younger man from a nation with high immigration fraud. Even if you got married and refiled, you still have an uphill battle.

Since the Age seems quite Large. Did you try to contact the embassy.Its different if the Petitioner is Male and Beneficiary is Female.

This isnt to say there wont be an approval at the consulate.

Provide enough evidence that shows ongoing relationship

Cancel out your K1 Petition if you intend to go through Spouse Visa

Okay do you know what else did they say or deny you on. They can not just deny because of age difference. What questions were asked at the interview? Ad who's the USC and who's the beneficiary? Who's older? Getting married doesn't erase the age difference. Are there maybe other red flags.

1. Race difference

2. Not enough visits

3. Visits short in duration

4. No pics with family or friends

What evidence did you present?

Gee I feel better I can answer yes for 1 thru 3 :unsure: . It probably wont matter to the CO but I am going to ask. We met in Nov 2010 I had a trip planned with my daughter to London in May 2011 so after talking for 4 months we decide he would try and meet us in London. However that didnt work out so that was 1 visit missed so I got to meet one of his best friends (he calls him his brother but they are not blood just very close) and my daughter and I spent some time with him while we were in London and yes we have pictures with him. Then in December I went for 2 weeks that was all I could get off work and yes we got married on that trip. Anyone I have talked to here knows that when I got back I ended up with my 4 granddaughters as soon as I returned and I still have them. However I am still planning a trip at the end of Sept for 2 weeks since it looks like they will be going home with thier dad at the beginning of Sept. I am hoping that he will get his interview around then and I can be there but since we are heading to NVC already there might be a small chance he gets his interview before my second visit. I know we have an uphill battle however my husband is very positive that he will do fine in the interview. I love how postitve and optomistic he is always. My question if I have everything booked and he has his interview before I get there will that be a postive for us. I wish I would of had the opportunity to spend more time there but that catch 22 of course you need to spend time with your spouse and want to but you need to support your family and have the money to support your spouse when the get here so you must have a job. Do they take into consideration the time in between visits. I left on Jan 9th and plan to return on Sept 21 so it is only about 9 months between visits. I know that no one can tell me what the CO will say but you are all much wiser than I on any of this and I appreciate any info and advice. We were going to postpone the NVC stage but when I check the poverty level guidelines we were okay and my husband didnt really want to postpone anymore than we have to and I agree this distance sucks... Anyway thanks everyone. You have all been a blessing...

Do try and get that second visit. At least thats what I am reading you have visited once. Or is that when you met in 2010 that was first face to face? Lagos really wants face time and the more the better. More visits or longer visits.

And yes the you need a job to support to make money and you need money to cvisit and to convince immigration this is real. Chats, phones and IM's just won't cut it for us in Nigeria.

Don't know if I get yout question about booking for a visit and interview happens before. That couldn't possibly be a plus because well you aren't there and anyone can book and say they are coming. Thats why they want to see boading passes and Visa Stamps to prove you were there.

And what do you mean "time inbetween visits"?

Well hope things go along as you plan and you can get unpostpone and get your baby home.

You have a denial against you for at least age difference ( but they probably wrote down something else ) If you are 20 years younger than him , how old are both of you ? Do either of you have prior marriages / children ? How did you meet and how much time have you been with him face to face ? The issues with jumping to the CR1 is that it is harder to fight if you get a second denial. You want to look at all your issues and see if you can address them with a K1 or a Cr1 better.

This will not be over quickly. You will not enjoy this.

I am definetly going again in September I just dont know if it will be after his interview or before. Sorry sometimes my brain gets ahead of my typing and I even confuse myself. What I meant about booking is if he gets his interview before I get there on Sept 22nd if he has a copy of my Visa and flight and hotel reservation will they look at that as a second visit or will it still be a negative because I didnt get there before the interview. What I meant by time between visits is we were suppose to meet in May so I went to London and he couldnt get there so 7 months later I went to Nigeria to be with him. I am going again in Sept and that is 9 months after my last visit so we havent had a lot of time in between to do visits that is what I was asking. I hope that makes more sense. I know it isnt going to be easy for us with all the flags so I just want to eliminate as many as possible...

No you get no points for booking. Thats no visit and no guarantee you will even come. No Lagos =Face time the more the better and the longer the BEST.

Its not as much the duration in between as the duration of the visit. Hopefully you can get there before or during his interview thats whats needed. After interview really doesnt get you anything.

Now I see so two visits. Okay how long was each?
