Received letter for Interview

I received a letter June 23, that I will have a interview scheduled for my pending I-130 at my local UCIS office. I live in Virginia so, the Washington offices. Yesterday, July, 5 I received a NOA to appear for an interview on the 28 of the same month. Which of course in my own opinion is great news, since the letter said wait 3-6 months. Here is my question. I am A***** H*******, the letter was addressed to my wife S******* H*******, who of course is back in Kenya. The letter says along the bottom in a document list : The petitioner and Beneficiary must both be present for the interview. Is this a trick to try to catch someone being illegally present? I would like to know if I should be trying to contact someone and if so who I should contact about this mistake, or should I just show up. The obvious fact is shes in Kenya, waiting for the process to get her visa, so she cannot be present.

austin yes you both have to be at interveiw i have some friends that filed aos and they had both be at interveiw if wife not able make it might postphone call and ask and have good reason could tell wife is visiting family ?

The reason she cannot be at the interview is, we are filling for an I-130, shes in kenya, how is she suppose to get here if the country will not let her in? Is there a special visa for these occasions I am unaware of?

More information are needed.

From what you said, it appears you are married to her, she is from Kenya and you filed I-130 to bring her to here.

If this is the case, then there might be something they need to verify that require an interview. Many of these letters are (generic/standard), so I would not worry about where they ask for you both to attend. you go, if asked, you answer why she is not there.

It would help to put more information about your case, and any red flags will help us to give you a better opinion

Hey thanks for the reply. Yea I had the thought that this may be just a blanket form of a notice they sent out, but I'm not trying to leave anything in doubt with whats obviously up for stakes. I just got off the phone with a USCIS rep on the national customer service line, he said its probably just another standard letter they send out and any issues with it can be taken care of during the interview date at the office. The reason of her not being present should be obvious to them.

Your profile says that you filed for Adjustment of Status. Did you file anything else (like I-485) along with the I-130?

If you did then USCIS thinks your wife is in the US!

You need to correct that so she'll get an interview overseas...

Hey, Well she was given a document to give the embassy in Kenya when she arrived. ( I can't remember at this time what the form was called) She has a signed copy of it, which I asked her to send a copy of for the interview in-case it is needed. I will also hopefully have the itinerary of her flights. Though I would like to think they are aware of her being in Kenya due to the form she submitted to the embassy in Kenya, to show her presence.

Call Them, get a Human, a Tier 2 , ISO.
