You can apply for an expedite on your paperwork. It has to be a compelling reason, but I believe that your case could be considered one.

I would call over to the USCIS and speak with someone about options.

2005- Met through mutual friends

2009- Started our relationship

July 4, 2011- Engaged!

August 1, 2011- We're Married!!!

USCIS:

September 16, 2011 - I-130, Fedex to USCIS

September 26, 2011 - NOA1 ( Received )

March 16, 2012 - NOA 2

NVC:

April 12, 2012- Sent NVCResarch copy of reciept for inquiry

April 18, 2012- Called Congressman to ask for assistance

April 20, 2012- NVC Received petition

May 1, 2012- NVC Case number assigned

May 2, 2012- DS 3032 and AOS invoice recieved

May 3, 2012- Paid AOS bill, submitted DS- 261

May 4, 2012- Submitted AOS

May 11, 2012- Recieved IV invoice, Paid IV bill

May 14, 2012- IV bill payment received by NVC, Filled out DS-260 and submitted

May 15, 2012- IV packet emailed to NVC

May 21, 2012- Case complete!!!!!!

June 13, 2012- Medical appointment

July 9, 2012- Interview Date --- APPROVED!

July 13, 2012- POE

No, that would be visa fraud.

December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent

At this stage, if you want to be sure you can be with her when your child is born, the quickest way would be to apply for a B2 visa and be here for your wife and kid.

You can't apply for the greencard yourself. Your wife will have to do it and maybe she will be in a better position to deal with the paperwork once the baby is born and after you have returned to Sweden.

Entering the US on a tourist visa with the purpose of seeking Adjustment of Status is a bad idea.

But B2 visa is hard to get for me because I cannot prove strong ties to Sweden other then being a swedish citizen.

Before i married my wife, i applied for a B2 visa to go and visit with her and eventually get married. But I was denied because of not proving strong ties to Sweden. I didnt have a job, apartment etc. I lived with my parents. Basically, i had nothing to return to.

How about now? I still live with my parents and i dont have a high income. Will i be denied B2 visa even though my wife is pregnant and high risk?

Unfortunately there are no guarantees that you will get a visa this time around. You may have to explore the option of benefiting from the VWP. In principle you would not need a visa for a visit up to 90 days with a Swedish passport. With such short notice there isn't much else you can do.

Ok, i forgot to say, for some reason I was not allowed to use the visa waiver program. Instead i had to apply for a B2 visa.

In this case, you will need to apply for a B2 visa again. It will be a tough sell but you will never know if you do not try. It might behoove you to obtain an affidavit from her doctor to the effect that her pregnancy is high risk. If your visa is denied again, then she can get started on your immigration papers and try to expedite them.

Keep checking here in case someone else has other ideas.

That would be really mean of them to deny me a visa when my wife is pregnant, just because my life here isnt stable enough.

A CO is not going to care if your wife is pregnant or not, their job is to evaluate your current situation and then make a decision based on current laws, procedures, and guidelines.

Ok, i forgot to say, for some reason I was not allowed to use the visa waiver program. Instead i had to apply for a B2 visa.

i would focus, for the weekend, on figuring out why you cannot start wth ESTA web site, then re-examine those reasons why vwp isn't available to you before anything else.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Are you a Swedish citizen?

Why did you apply for the B2 before rather than go on the VWP?

Any criminal convictions or otehr reasons you cannot use the VWP?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
