Tax Return for i-864EZ

hello,

i just filed my dad's I-130 and got approved and now waiting for the case to be forwarded to NVC.

i am currently deployed and out to sea right now so mailing docs will take forever!

my issue is, for my AOS docs, i understand that we have to meet the poverty guidelines. and i need last 3 years of my return(me and my husband filed jointly), i just started job late May 2011 so on my W2 i did not meet the poverty guidelines, for 2010 its just my husband's income from the Army and he got out in July 2010 so on his W2 it didn't meet the guidelines too, we only met the poverty guidelines in 2009.

what should i do and what should i send so i won't get RFE and process will go faster.

i don't have anybody to co-sponsor me.

Only the latest tax return/tax transcript is needed. 2nd and 3rd most recent are optional to send in, but you still have to declare the amount on the I-864(EZ).

What matters for you to qualify is your current income, as in how much you earn now computed to a whole year, and not the amount shown on your tax returns, because those reflect your past income.

Take our case as an example. My husband only started working September of last year, so only 5 months worth of work is shown on his ITR 2011. What we did for the current income was to take the average amount on his paystubs, and multiply by 26 (52 weeks a year, but he gets paid every 2 weeks, so that's 26). We sent in a couple paystubs with our AOS package.

I agree with reginakrys. You only have to show last year's ITR.

My wife had her interview yesterday and got approved...

We only showed our last year's ITR and provided no other proof of income from any other year prior to last year.

You may read #25 from the included link below. The fist sentence which states you only need to provide the previous year tax return.
