The K3 is obsolete, is there a specific reason you are trying to get this visa instead of a CR-1?

Bye: Penguin

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What's the differnce between K-3 and CR1?

K-3 used to be a spouse visa which would let your spouse come to the US while the underlying I-130 petition was still pending. The spouse could then adjust status, much like a K-1 visa holder today. However, the K-3 was designed for a time when the I-130/CR-1 process took much much longer.

More recent processing times for the I-130/CR-1 has left the K-3 worthless, as it's processed in roughly the same timeframe as the CR-1. When both are approved at the same time, the K-3 is administratively closed, and only the CR-1 is left to apply for.

Focus on the I-130/CR-1 process.

But don't worry, if you filed for the K-1 (I-129f petition) you would have had to file an I-130 (for CR-1) at the same time. So if you filed for K-3, you also filed for CR-1.

Not quite correct, administrative closure of the I-129F filed to start the K3 process occurs when the NVC receive both petitions at the same time or if they receive said I-129F when they already have an approved I-130 on station.

hey Guys, my case is the same. I got approved i129f and i130 on same day. The complication here is that my wife got a lawyer and the lawyer is so confident that my i129f will scale thru faster. I know you all say they take around the same time, but if my i129f scales thru first , i see myself doing my medical and interview before the end of July. All i want now is for us to be together as soon as we can. thanks

If you are a US Citizen, you have not applied for any visa. You filed a petition. When it is approved, your foreign spouse will be invited to apply for a visa. Click on the word "Guides" at the top of any page here.
