time limit to file I601 waiver?

Hi Everyone

Sorry it has been a while since my ls posting... Have been swamped with work, researching the 601 waivers, and I think fighting depression and fustration. I have to be honest... also it hurt too much, I had to take some time away from VJ.. I may not have posted too often but read everyday people's postings and I will say WHENEVER I did post everyone was great with their help!

I guess I never gave you guys any background on myself.... I have been a single parent for 21 years now. Have always worked two full time jobs to do my best to provide for my daughter. Well as you can imagine this took a toll on my social life because I choose putting my daughter and her needs above any personal needs for myself.. No regrets just a choice I made...Don't get me wrong, I dated here and there but only one serious relationship for 4 years... my family just thought I was too fussy... no not really unless you count being fussy over who was involved with my daughter's life.. Yes I guess I was fussy.. This and working so much men and other people like friends just didnt understand and gave up trying to hang out.. I can't blame then. Well working so much seemed to make the years go by wayyyyy to quickly. Just after putting my daughter through 4 years of college... I began dating a coworker of a mutal friend.. I had known him for about two years before we dates... Well things clicked right from the beginning and he is now my husband... We have both gone down the spouse visa journey's ups and downs, misinformation or lack of information resulting in set backs... but made it through... until...

My world came crashing down after our interview at the Montreal Embassy, we were denied due to my husband not completing 10 year ban due to overstay in the past. The consulate letter said he is not eligible for spouse visa until December 2007. My husband was upfront and honest with the officer about the ban and he told us it was definitely better that we told them then instead of them finding out after the FBI fingerprint background check. The Montreal consulate officer was VERY nice and said we could file I601 waiver and I212. Now my question... ( So sorry I got sidetracked earlier in this posting... but I guess it might be the depression, fustration, needing to talk to someone... or something... thanks for allowing me to ramble.. and thanks even more for listening) My question.. is it true there is a 30 day limit to file the I601 waiver? Today is 30 days from our denial letter and I have not even gotten in with the lawyer yet, not to mention gathering of supporting documents... Please does someone know for sure? Ihave tried for past 8 days to get through to the Montreal Embassy to find out!

Please I just dont know if I could handle this let down...

06/07/2006 NVC CASE COMPLETE! (278 days from I130 submitted to NVC case complete)
August 2006 Interview at Montreal Embassy, need to submit I601 & I212 waiver.July 2007 submitted waivers to Montreal Embassy who forwarded to Vermont Service Center
October 2007 rec'd receipt and notification or waiver processing from VSC, April 2008 rec'd RFE for I601 July 2008 submitted RFE, and rec'd receipt, advised written decision within 60 days
October 24, 2008 sent written request for case status to VSC, May 2009 after written request for status update recd letter "being processed"
July2009 requested Senator inquiry again.. response "with officer, required extra processing" if no response check back 6 months!
Dec 09 requested senator inquiry again, Jan 8 2010 requested more than "general inquiry" senator Jan 11, 2010 Senator requested supervisor
Jan 12, VSC told senator's office we wld recd notice in mail 7 - 10 days Jan 20, 2010 I601 DENIED.... letter dated Jan 14, 2010
April 2010, granted 290b approval to send to Appeal for review

October 2011 Appeal denied due to fraud, now dumped by husband, now with Canadian Arabic woman from Tunisa for Canada residence.. processing Immigration with her now

thru Canada

July2013 He ws deported back to Egypt almost a year ago due to out of status for almost 2 years

I'm not sure about this one. We filed ours the same day but I was reading on Immigrate2us.net and I saw a post there that said there is no time limit to file the waiver. (thought it might be your post) Only a 30 day time limit to file for an appeal if your waiver was denied.

Hopefully you can get through to the embassy soon.

Felicia, if you look at my time line you'll see that I didn't file my waiver right away either. There was probably a 30- 35 day time period from our interview till the waiver was finally accepted in Montreal. I have been informed that overstay waivers are usually approved in Canada after the ban has been served. Could be wrong but that's what I've been told. Hope this helps.

Married August 21 2004 in Nova Scotia!

October 19/04 sent I-130.

April 17/08 finally arrive back in New Orleans after 3 years and 8 months.

May 19/08 Perm Resident Card arrives.

July 24/08 Reapply for a new SS card with married name.

August 4/08 Baby daughter born.

hey i just need lil insight from u. did ur husband have any trouble with montreal being a refugee in canada on ur interview day? how was it?.

Not sure if I am reading this right so if wrong please disregard.

When I received my I-601, I was told and it was also noted in the information package that the I-601 needed to be done within 12 months of receipt.

Mine was not for an oversay so there may or may not be different time limits.

If your husband received his I-601 at Montreal he most likely received the forms and an information packet with the infiormation you are seeking.

I hope things go well anmd quickly for you and your husband
