How my child can become a US Citizen

Hi there,

I'm US citizen, my wife and two years old daughter came to the US via wavier visa from the UK. I've already filled 130 and 485 for my wife then included my daughter in the forms. My wife has received her EAD card but not heard anything regarding my daughter.

My friend told me that as a US citizen that my daughter is automatically a citizen. Please can you tell me what to do to make my daughter to become a US citizen? Do I need to fill separate forms 130 and 485 for her (she doesn’t need a green card, she’s only a minor)?

How long have you been a US citizen? If you've lived in the USA for 5 years prior to the child's birth, 2 of which after age 14, she is indeed a US citizen.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I got my US citizenship through naturalization 8 years old. My wife and daughter are British (daughter was born in the UK). So they both entered the US via WVP (Dec 20 2011) and decided not to go back to the UK. My wife’s AOS application is looking good just worried about my daughter. My wife didn’t apply for US passport in the UK for her because they weren’t planning to relocate.

Or should I fill for 130 for her?

So you became a US citizen at age 8. How long did you live in the USA after that, and at what age> This is crucial to know whether your daughter is already a USC or whether you need to file AOS for her, same as you did for your wife.

No choice with my stepdaughter, because of that step, had to file a 130/485 with a bunch of other forms for her just like her mom. You mentioned not hearing anything about your daughter, same with mine. Wife went through, but my stepdaughters' application was somehow misplaced. Got into the http://www.visajourney.com/forums/forum/111-bringing-family-members-of-us-citizens-to-america/ section of this board, was not the only one.

Technically, you should have visited your US consulate in the UK with your citizenship papers and received a US passport for your daughter right after she was born, or at least before she came here.

This is crazy in this country, if you are here illegally and have a kid, that kid has a born in the USA birth certificate and is a valid US citizen from the start. It's that crazy place of birth issue you have to deal with.

If I were in your shoes, first attempt would be to apply for a US passport for her, we have some 9,000 agents in this country. In my little town we have two, the post office, called him, been doing it for six months, also the clerk of court, she has been doing it for over twenty years. If both were inexperienced, would go to the next town and call, not afraid to ask about their experience. If not in the next nearest town, within a 50 mile radius have five other much larger towns to deal with. Just saying find an agent with some experience, fill out the application form, can download that from the DOS and give that a try. Tells you exactly what evidence you have to bring in and will cost you a couple of hundred bucks. Give that a try and see what happens.

Your daughter still does not have a born in the USA birth certificate even though technically she is a US citizen if you met all the requirements. Would also apply for an N-600 that will last her a lifetime for the 600 bucks.

Believe your daughters US passport will say, born in the UK, this is out of my league as to what agreements we have with the UK, not my agreements, but those guys that get way overpaid and have those expensive social parties because they helped our president get elected. In my case with both my wife and stepdaughter now as US citizens by choice, wife was born in Colombia without her say, and stepdaughter was born in Venezuela, also without her say. But those places of birth remain on their US passports, so if my wife wants to visit Colombia or my stepdaughter to visit Venezuela, still have to maintain passports for those two countries. But can go anywhere else in the world except the countries they were born in.

Fought this tooth and nail with both my senators and the DOS and got nowhere, nobody really knows why, just always has been that way. So came to the conclusion we have a bunch of idiots running this country. Believe your daughter will always be a citizen of the UK. DOS doesn't like to call that dual citizenship, use dual naturalization instead. A bunch of AH's in my opinion, it is dual citizenship!!!

I went to the post office today and applied for US passport for my daughter.

The lady at the post office was very helpful although she first said “you can’t apply for US passport without SSN” then said “let me make call DOS to find out if it's possible without SSN”. she put me on thephone with DOS, asking me “how long have you been a US citizen and when did your daughter entered US” told her then showed her my certificate of citizenship and US passport.

Submitted my US passport, certificate of citizenship, wife's British passport, my baby’s birth certificate, her British passport, passport photo and fees with the application.

My wife and I have learnt in a big way that we should’ve filed a CRBA in the UK. I even suggested her given birth in US but she refused.

I’ll keep posted when I received the passport!

Hope she gets that US Passport, but would still consider filing for the N-600, that is permanent, with her passport, can apply for her SS number.

With government agencies can run into what comes first, the chicken or the egg. If the DOS insisted on getting an SS number first, your daughter couldn't do that unless she proved she was here legally. Either with a USA birth certificate or a green card. Babies born here from illegals have that US birth certificate, they don't have problems and can instantly get Medicaid.
