APPLIED BOTH K3 AND I-130

hubby and I agreed to file for K3 visa, so he sent the I-130in August 2011 and on Nov. 2011, after he received the receipt# from USCIS for i-130, he filed the i-129F. we waited for USCIS for approval of the i-129F, but on may 2, 2012, he received letter from USCIS(NOA2) stating USCIS approved the petition and sent the visa application package to NVC. My question is, since they approve the i-130, does that mean K3 visa is cancelled or forfeited? Thanks.

Oct. 2007 - First Meeting

June 2008 - Got Engaged

Jan.- March 2009 - Second Visit

July 26, 2010 - 3RD Visit - Got Married

Got Pregnant to our First Child - Yaaayyy.. :)))

Dec. 2010 - 4TH Visit

March 22, 2011 - 5TH Visit - Gave Birth To Arizona Jolena Hawkins aka "Zoey"

March 27 2011 - 6TH Visit - Hubby came home for Zoey's birth "One Happy Family :))

Jan. 2012 - 7TH Visit

Feb. 2012 - Zoey got her American Passport and US Citizenship

May 2012 - 8TH Visit

Visa Journey:

Augusy 2011 - Filed I-130

August 23, 2011 - NOA1 Received

May 2, 2012 - NOA2 - I-797 Received - APPROVED

June 5 , 2012 - NVC received Petition

June 9, 2012 - Received DS3032 and AOS Invoice Bill

June 9, 2012 - AOS Fee Showed PAID

June 13, 2012 - DS3032 sent via email- received auto response from NVC

June 20, 2012 - DS3032 received by NVC

Approved I-130 means I-129f is canceled. No K-3. You are going on the CR-1 path.

Approved I-130 means I-129f is canceled. No K-3. You are going on the CR-1 path.

Do we need to submit letter for the cancellation of the K3 visa application? or just disregard and continue with the CR-1? Just want to make sure that we won't get any more problems in the future, regarding the K3 application. Thanks.

Important Notice: Effective February 1st, 2010, when both petitions have been approved by USCIS and sent to the NVC or when USCIS approves the I-130 before the I-129F, the availability of, as well as the need for, a nonimmigrant K-3 visa ends. If the NVC receives both an approved I-130 petition and an approved I-129F petition:

  • The nonimmigrant K-3 visa case will be administratively closed.
  • The application process explained below will not be available to the foreign-citizen spouse and cannot be used.
  • The NVC will contact the U.S. citizen sponsor and foreign-citizen spouse, with instructions for processing the IR-1 (or CR-1) immigrant visa

There is nothing for you to cancel -- the I-129F petition will be closed at the NVC. The I-130 will be continue to be processed until Case Complete, upon successfully completing your interview, depending on how long you've been married, you will be issued an IR-1 or a CR-1 visa.

well, you mentioned the approval notice on the I-130, but

what about the approval notice on the I-129F?

these are two casefiles, each having 2 receipt numbers.

Ultimately, the I-129F will be administratively closed when it hits NVC office, but for completeness, please find out the status on the I-129F - your husband may have received an approval notice for it and forgot to mention it.

So, basically, dig out the first I-797-C letters (there are two) - review the receipt numbers, then cross reference those receipt numbers with the 2nd set of I-797-C letters (there will be one or two) and let us know what's what?

I just checked the receipt number for i-129F, status is for "initial Review" . While the receipt number for I-130 says "approved and sent to NVC'.

Yes i did checked it online at USCIS website, my husband received only 1 approval letter as the present, that is letter of approval for i-130. Maybe they will send us another letter for i-129F in the next few weeks.
