Assets or CoSpnsor: Recommendations Please

Greetings VJ,

I'm sure the topic has been covered many times over so if one of the experienced members wants to throw me some links, I'd be much grateful.

If anyone wants to offer direct personal advice here is my situation:

I don't have income now. I will have some to show on 2009-2010 tax returns, as my ex filed for both of us when we were separated. 2011 i have nada- I'm a full time student and divorcee so aside from child support (does that count on the AOS?)my income is not so much of anything. If we make it past the i-130 process ok, and survive the end of the world in Dec 2012, I will of course have nothing to show on 2012 returns either.

My spouse has land assets in the UK that would more than cover the amounts (over 100K worth), though he is Egyptian living in Egypt. We have a potential co-sponsor who has already agreed to help if necessary, but we'd like to go at this alone if possible.

Is proving assets a hard thing? I am trying to figure if its going to be too much trouble to prove or if its doable. I am guessing having a co sponsor is more straight forward and easier right? I would like to start working on paperwork right away even though our I130 has just been accepted

A joint sponsor would probably be the most straight forward way to go. With assetts, you need to show that you can have the cash available within a year (correct me if im wrong anybody! Ive not got to this part yet but been researching) which i dont expect is very easy to do. Especially with it being in the UK. You cant sell anything here at the moment unless you accept rock bottom prices. It wouldnt hurt to put both down though. At least with both, if they arent satisfied with the assets, it wont delay anything.

My husband (the petitioner) also has no tax returns since 2009/2010 since he was a student and then he moved to the UK. So we will be using a joint sponsor.

12-11-2012 : Went to the Social Security office to apply for SSN after it did not arrive.
12-15-2012 : SSN Arrived in 4 days.

05-09-2013 : Left USC Husband.
11-28-2013: Filed for divorce.

05-01-2014: Divorced

05-08-2014: Sent I-751 petition to VSC

05-13-2014: NOA1 (was not postmarked until 5/22/14 and received on 5/24/14)
06-18-2014: Biometrics in St. Albans, VT

11-21-2014: RFE. Received on 11/24/14.

01-22-2015: Interview notice mailed out. Received 1/26/15

02-12-2015: Interview in St Albans, VT - Approved during interview!

CRBA
08-16-2012 : CRBA in London for our daughter - Approved!
09-11-2012 : CRBA and Passport arrived.
09-25-2012 : SSN Arrived. Mailed from MD on 09-17-2012

Actually, in this situation, it COULD hurt to try to have an Egyptian spouse use land assets in the UK to self sponsor. Particularly in this specific set of circumstances. It probably would look like the wealthy Egyptian was in a fake relationship paying the USC to help them get to the USA.

A "joint sponsor" is the way to go on this one, if possible. Then simply ignore the foreigner's assets.

Facts are cheap...knowing how to use them is precious...

Hmm...this is a good point. Glad I have VJ to think outside the box. These are the kind of things that don't occur to the average person. I will consider this.

Yes, if they consider the assets sufficient, they will disregard they can disregard the joint sponsor. However, I would expect that significant assets of an Egyptian spouse, particularly if he more than a very few years younger than you, and worse if you were not of the same religion at the time you became acquainted, to make a NEGATIVE impression with regard to the bona fides of the relationship, potentially sufficient more than overcome any positive financial impression.

Facts are cheap...knowing how to use them is precious...

Additionally, assets held outside the US are not as easy to use as assets in the US. For the simple reason that if the asset(s) was needed to satisfy the I-864 contract it is more difficult to liquidate when held outside of the US. So the interviewing officer may not accept the assets presented even though the I-864 was passed prior to arriving at the embassy/consulate.

The interviewing officer has the final say and views the entire file in totality. Why have an aspect that brings additional scrutiny?

Well- age wise, he is older and never been married: hopefully thats an asset and not a hindrance. Religion wise- we made our acquaintance gaming and I was a different religion than him and also married. Not sure I can explain without more details of my personal life than I care to make public, but between our first acquaintence, and engagement, I had converted and divorced. How this looks to a CO, I don't know.

Never the less, all other things aside, I suppose I can look like an easily duped, lonely single mother with a rich suitor to pay me off for my services... sigh. It'd be impossible to explain without a few hours of story telling!

Does the fact his dad is a dual citizen of UK and EG help? My spouse is a high school grad of UK, with a 10 year visa to there. I'm hoping this is another asset. He also came here on a student visa for 5years. I could use a few things in my favor to escape what to an outsider is an episode of desperate housewives.

This is the bottom line, I think.

You don't need to explain or convince us. Yes, that he's older and a UK high school graduate etc. is all better than if it were otherwise but the bottom line is still the bottom line, hence the recommendation to skip the foreigner's assets and use a joint sponsor.

I'll keep focused on that. I just like to know when they're gonna throw me any curve balls so I can deal with them. I know most everyone here has a story and is genuine and this group is the least I need to prove myself too. You all know though if there's something they're gonna jump on as a major red flag. ;)
