Visa Approved (via I-601) but ESTA denied!

Hi,

This morning my passport arrived from the London US Embassy, with my visa neatly stuck inside. However, I cannot book my flight to Texas as I am still denied by ESTA. (VWP was denied as my visa was initially denied, but finally approved via the I-601 waiver).

When I try to update my ESTA details on their site I just says it's denied. I can find little help online, and have registered an online query with the US Customs & Border Protection website in the hope that they can help.

Would anyone here know what I need to do so that I can finally join my wife (married 22 July 2010).

Timeline

If you have a CR1 visa inside your passport you are not required to do an ESTA. You're visa is your permission to enter the US as a legal permanent resident!

Which makes sense. However, when I try and book the flight ticket with United Airlines, the booking is denied due to my ESTA denial, which is still in the system.

Yea, you need a human. ESTA is irrelevant if you have a visa in your passport. Either that or try a different airline.

As far as I remember, United's website doesn't even ask if you have a visa or traveling on visa waiver so yes, get a human.

Yeah you need to call them. Continental denied our booking because I booked a one way, and they said as I was from a visa waiver country I needed a return flight... took a supervisor to realise a visa is better than a visa waiver.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, I must complete my timeline. It's been a right rollercoaster ride of terror!

I called the US Customs & Border Patrole and a pleasant lady told me that my visa in my passport carried much more weight than any VWP and that everything would be alright. I explained that I still couldn't book my flight, to which she advised me to contact the airline.

I did just that, and booked my flight over the phone. So job done, and thanks for all your input.

There of course, may be a dilemma whenever I try to book international flights online as the ESTA denial will probably crop up again. Unless it is updated when some official scans my passport into the system.

The next hurdle (and hopefully the last of very many we have had) will be the interrogation at the aiport.

You do not need ESTA to immigrate to the US.

The airlines rely on ESTA and the VWP when a person wants to travel without a visa. Once a visa is denied, the ESTA is locked up, and the airlines will not allow you to fly without a visa into the US.

The waiver for a visa is not common for the airlines. The US does not report when a person gets a visa to the airlines. The US only report a denial.

It's not a computer problem. Computers are not stubborn or stupid. They only know what humans input into them. If humans tell the computer to lock up ESTA after a visa denial, then the system will not let the person buy a ticket. If humans don't tell the computer that the visa denial has been reversed, then the computer doesn't know.

To override an ESTA lockout when you have a visa, you would need to contact the airline by phone.

I didn't even know airlines verified your ESTA status when booking a flight.

Yup!

Prior to boarding, the airline will electronically verify with the United States Customs and Border Protection that you have an approved travel authorization on file.

There oughta be a way that a visa holder or LPR can submit that information though, so ESTA can be ignored for people who don't need it.

So when is your flight?? You must be so relieved it's almost over and life can begin! Congrats!!! How long did london take to process your waiver and what were your grounds of inadmissibility (if you don't mind me asking). We will be in the london I-601 waiting line soon...
