NVC stage and need you ideas and opinions

Hi to all. I just want and hope that someone can help or give us ideas and information regarding on this matter.

Our NOA 1 was September 29, 2012. We got approved in USCIS last March 19, 2012. Our case number dated April 13, 2012. We are now at the NVC stage. Paid our AOS bill last April 19, 2012 and sent DS-3032 on the same day.

I am now worried because I am thinking that I am pregnant. If I am pregnant, I want to give birth here in the Philippines because it is very expensive in the US. We got 2 USC kids which is listed in the I-130 form. It is very complicated and really confusing on what to do if I am pregnant. If ever it is positive, due date will be December or January. Then we have to wait for the CRBA for the child.

My questions are:

1. Do you think we can delay the process at the NVC? There is a period of 1 year, if they did not hear us, they terminate our application. Is the period of one year starts from the date they give you the Manila Case number?

2. We are doing counting so that it is a good timing for the visa expiration (which is 6 months validity). If I deliver on December, we have to stay here in the Philippines for about 2 months to process the CRBA. Are we going to inform the NVC about the new child?

3. When can we submit the AOS package? Is it before or after the baby born? I am thinking we will submit the AOS package around August or September so that by February or March the visa is still valid. Do you think it is not a problem if we submit the AOS package that late?

4. When we paid the AOS fee, my husband did a mistake. He put the middle initial A instead of M. When we printed the receipt, the letter A appeared as the Payer. Are we going to inform NVC about that mistake?

Timeline

1. Yes you can delay and/or slow down the process, NVC can only act based on you following up by submitting documents or paying the invoices. The 1 year starts from the last official contact between NVC and you. Based on what you wrote -- you have plenty of time to work your plan.

2. Other than including the newborn on the I-864 for purposes of determining your household size, there is no requirement to make any extra effort to inform NVC about the birth of your baby.

3. You submit the AOS package when you're ready to move forward. You will not be the first to submit the AOS several months after payment of the invoice.

4. Yes, you need to correct any mistake regarding your name -- names matter.

Paying the IV fee and submitting the IV package are the final steps in the NVC process you have any control over.

If an immigrant has a non-USC child after an immigrant visa is issued but before the immigrant enters the U.S., CBP is authorized to issue the newborn a derivative immigrant visa at the border.

Your situation is different because your child is a USC, but it makes me wonder whether you really need to wait in PHIL for the CRBA. Perhaps CBP can admit the newborn even without a U.S. passport, at least if he has a PHIL passport and proof of relationship to you and the dad. Maybe you can ask the consulate if you interview and are pregnant.

Yes you can delay the visa process. The consequence will be that you'll need to go to the time and expense of a Consular Report of Birth Abroad plus US Passport application for the child. This is likely to be delayed by request for DNA tests.

If possible, I would suggest your husband get you on his health insurance at work ASAP so there will be only a small cost for childbirth in the USA. Yes, it's expensive, but that's what insurance is for. Check this out ASAP.
