So...I've encountered another obstacle. And this one...I'm not sure I can get out of.

I'm partially to blame for this, because I took the words of the person at the USCIS as truth and didn't think to call again and double check, cause....I thought thats what they were for....to give the right information.

I had a problem that I posted about a couple weeks ago, which was about it taking over two months to receive Craigs birth certificate. Well, thankfully, he received it a few days later. I remember in one of the posts someone mentioning writing a letter and getting it notarized because the 'valid date' on his approval notice was going to expire. So, I called the USCIS (figuring, they issued the approval, it would be up to them) the guy I spoke with told me there wasn't anything to worry about. So, I took a sigh of relief thinking "Ok, maybe the last leg of this will run smoothly"...unlike this whole process.

I should have asked you guys. I should have looked at the guides much sooner and noticed the letter for extension on the I-797...but I didn't, that is....until today. Thats when I actually noticed it. Thats when I called the USCIS again and spoke with someone who knew as little as the first person I spoke with. I'm not sure how many times I told her it was an approval, he had yet to have his interview, and is most definitely NOT in the US (She was telling me "Sorry, he's going to have to leave the United States") :bonk: She finally understood what I was asking, put me on hold and came back to say that it was out of their hands. I now had to deal with the Embassy. Duh, stupid me. So, now...as of March 1st, the approval is...I guess...invalid.

I contacted the embassy today by e-mail, but...it was already too late. I'm 8 hours behind and they apparently dont work on the weekend...

Short story, long :( (Sorry guys) I'm wondering what my options are. I have the letter already typed up. I did that in a panic...I even called a place to get it notarized, they are open on the weekend. I can have it overnighted and hopefully they'll get it Monday morning. My question is...will it make a difference? Will two days be enough time for them to process that? I'm figuring 'no', but I'm not sure what else to do. Is this it? Are we going to have to start the process all over again? :(

Carrie is correct they will just extend the NOA date. Good luck and you will not have to restart this process.

Mine expired before my interview too. Only by a few days thou. You will be fine, just email them. They will email you back saying it is fine. :D

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

Yeah, it is up to the Embassy to renew the petition because they were unable to give you an interview in time. The only thing you could need on your part is an updated letter of intent for the interview. Sometimes they ask for this if the petition has expired and it's always better to have it in case they ask for it, if they don't then no biggie, at least you were prepared! :)
