Removal of Conditions interview

I recently replied to an RFE. I have read if you are going to have an interview often an RFE is an intermediary step. At the moment I am between jobs. If I did have an interview and they asked about my job and I answered I am between jobs would this somehow invalidate the affidavit of support? I am NOT planning on lying but if it was a potential red flag and if I did get an interview I would scramble to get a job any job before the interview occurred. However if it is not a red flag I will continue my search for an optimal new job.

03/26/2009: NVC in
04/08/2009: Learned we are being screened for Additional Processing 'AP'
05/09/2009: Arrived at the US consulate in Bangkok
05/15/2009: Medical Passed
05/20/2009: Packet 3 received
05/21/2009: Packet 3 returned

07/08/2009: Interview
07/08/2009: issued 221(g) due to proof of single status document missing a stamp
07/20/2009: Resubmitted document with missing stamp. Accepted
07/23/2009: Visa issued


07/28/2009: POE JFK
07/31/2009: Married
09/02/2009: AOS submitted
09/10/2009 NOA1
09/25/2009: Case Transfered to CSC
10/13/2009 Biometrics
10/26/2009: Received EAD card
11/30/2009: RFE Delayed Birth Registration
12/31/2009: USCIS receives RFE reply
1/07/2010: Green Card Delivered
1/15/2010: Green Card Arrived

10/10/2011: Mailed in I-751 to remove conditions

03/29/2012: RFE USCIS wants more proof of a bona fide relationship

5/18/2012: Email notice that Green Card is being produced

An RFE is a request for evidence. That means people didnt supply sufficent evidence for the case. I dont know what that has to do with your job situation.

When you are asked about your employment simply explain your current situation & your plans to do the best you can as the economy improves. You could indicate your plan to take a job to fill the gap until you find a better one. This is no different than many others are doing across the USA. You may be asked how you intend to provide support for your spouse for some period of time. I would prepare to explain I had a co sponsor that could be submitted if needed.

the immigrant is applying for ROC. The I-864 is in force and income is now irrelevant.

You may be asked how you intend to provide support for your spouse for some period of time. I would prepare to explain I had a co sponsor that could be submitted if needed.

For AOS yes, for ROC it's irrelevant. The I-864 carries over from AOS so income doesn't matter anymore.

Does this mean that when we apply for 10 year LPR card from the Conditional my husband has they will use the earlier Income figures or will we need to provide our latest Tax returns? He actually earns more than me now will that be a problem? Should I still be able to meet the Poverty Guidlines with my income alone?

They don't use ANY income figures. Your income, his income, ALL income is totally irrelevant come ROC. He proved income for AOS and that carries over (even if he earns more or less). You include IRS transcripts simply to show that you filed joint (proof of relationship), the income don't matter.
