I am 19 and have never worked. (no income)

I am studying pre-medicine and have 2 more years to go. I have never had a job before so I have no income. I still live with my parents and they say they would be my co-sponsers. My fiance also has never worked but he plans on getting a job when he comes here. His parents are wealthy and they plan on buying us a small house or apartment as a wedding gift (but there is no way to prove this), and our parents would help pay our studies. Then when I graduate I plan to take a year or two off of school to work while my fiance finishes his studies.

My question is, will we have problems because of this? Can a co-sponser be responsible for 100% of the income? (since I have 0 income). Another problem is that my dad made 47k this year in taxes (for a family of 5, including my fiance). This meets the 125% poverty line, and last year he made 34k which is also barely enough. But two years ago he only made 22k and we had a shortsale on our home. He is self-employed (owns a handyman company).

Any advice/comments are appreciated! All of this has had me kind of worried.

If your dad make enough for 2011 to support family and your fiance, meaning over the 125% poverty line, than he could be a co-sponsor.

They look at and care most about current income.

You still have to supply the affidavit of support forms regardless of your parents co-sponsoring as you are the petitioner.

Thanks for the quick replies! So they don't care that I have no income, as long as my dad can support him?

Its not really about supporting him - its about proving that he will not become public charge when he gets to the USA. Basically if he trys to apply for any means tested benefits eg: welfare, some medical, food stamps etc your father will have to pay back everything.

Ahh, ok, thanks! Do you know if financial aid for university counts as government help? Because schools are so expensive, we were hoping to be able to get financial aid for him.

Once he adjusts status and receives his green card, he will be eligible to apply for federal student aid: http://studentaid.ed.gov/PORTALSWebApp/students/english/Glossary.jsp#elegiblenoncitizen

Would someone mind explaining or linking me to the financial rules/guidelines involved with the k1 visa? I wasn't even aware there were any until recently- do ALL k1 petitioner's have to meet a min. income requirement?

The poverty guidelines are here: http://www.uscis.gov/files/form/i-864p.pdf

The petitioner has to complete the I-134 and I-864, regardless because they are the primary sponsor of the fiancé(e). If they don't meet the minimum, a co-sponsor may be an option. The co-sponsor would need to count the fiancé(e) as part of their household in addition to anyone else they claim as a dependent. The I-864 is legally binding, so they should read through the document very clearly to understand what they're signing. (Note: The ability to use a co-sponsor for the K-1 may vary by embassy, so please check with the relevant country first.)

When I was a student at at university, I was unemployed and I submitted affidavits of support on behalf of my Mom and Dad and they had great jobs. The US Embassy in Laos still demanded that I meet the poverty threshold.

Poverty threshold in the United States for 2 people is pretty lenient too, at a mere $19,000 at 100% if you are in the military.

Everyone else has to go to like 125%-150%.

Don't be surprised if you get denied. Lucky for me our case was just dragged out pending "requirements for proof of finanical support", mostly from myself.

It shouldn't be a problem. I also hadn't worked and my parents cosponsored my husband. The only thing I had to do which I didn't know I had to was write a letter explaining why I hadn't filed taxes. That letter was requested by the consul after my husbands interview. I gave the letter in and my husband got the visa that same day we gave them the letter.

Stafford loans are not means tested and are paid directly to the school.

Pell Grants and Subsidized Loans are means tested, and the intended immigrant will not be eligible for them, the US citizen, on the other hand is. If family contributes to paying for school, you wouldn't be eligible for them anyway.
