Getting ready for my I-864

Hello,

So i'm wanting to get ready for my I-864 finally! I just want to have it done and out of the way so I dont have to worry about it.. Now I have to have a co-sponsor, she is my husbands aunt that lives in GA. She has her naturalization cert. what does she have to send me along with her filled out i-864 form? proof of legal status, W-2s/transcripts? if she has 2-3 yrs worth of W-2s does she still have to have a letter from her employer? Can the proof of legal status be just a copy of her cert.? Thanks in advance

I filed with 3 years of IRS transcripts, 6 months of W2, letter from employer saying I still work here. << this is why you can't finish this too early!

A copy of the certificate of naturalization is fine. Your aunt will need to provide 2011 also since it's 4-15 in 11 days.

A copy of the certificate of naturalization is fine. Your aunt will need to provide 2011 also since it's 4-15 in 11 days.

No such thing as six months of W2. That's a once a year thing. A single pay stub showing employer name and year to date income is sufficient evidence of "current income". At least a complete copy of the 2011 tax return including W2 is required. If she has a good and steady job, no real need for any other tax returns but he affidavit does ask for information from the last three. That should be 09, 10 and 2011.

Facts are cheap...knowing how to use them is precious...

You only NEED to send the most recent year's tax return (or irs transcript)with all W2's and schedules attached in order. You must also enter the figures for the 3 most recent tax years on line 25. Read what it says there..Sending copies of 2nd & 3rd most recent returns are Optional. The only other Mandatory things you must include is the aunt's Naturalization Certificate, 6 months worth of paystubs OR a letter from employer showing salary, length of employment etc. You Do Not Need to send both, that's up to you. Now that's it as far as what is required at Minimum. This is assuming the aunt will only be using earned income from work to meet fed poverty guidelines. Others on VJ have sent more than the required, but I didn't and no RFE on this packet. :)

I am sorry to ask a question here. Is the employer letter necessary? Or not if you have tax transcripts?

Carlos, the letter from employer is only needed if you do not have paystub/s. Do send atleast one of these items along with your transcripts.

I am sorry to ask a question here. Is the employer letter necessary? Or not if you have tax transcripts?

Tax transcripts or returns are about past income. That information and documentation is required but so is documentation of current income. Employed people document current income with either a modern pay stub or an employer letter.

lol riight.. i was reading six months of W@ wth is that? ummm nooo such thing!! this is what i was looking for in the answer. I will let her know. I just wasent to sure if she needed a letter from the employer or not, shes been with them for a long time. Thanks you (L)

so she will still need a letter or employment or the 6 mon. of paystubs? i just want to make sure i give her the right info. yeh shes going to send me everything that is needed along with a copy of her Naturalization cert. Thank you!
