Well, first off, the tax returns can only be photocopies as the originals are sent to IRS.

As for pay stubs, they can be either or, doesn't matter as they're optional anyways. But I'd suggest sending photocopies.

I'm kind of panicking, I'm scanning my hubby's 1-864 and tax forms and have noticed some problems.

For his current individual income he put his business income (he's self employed) he put his adjusted income for the past three years on question 25, like the step-by step says. Neither amount is enough to cover the poverty guidelines, both amounts are in his tax transcripts, is this going to be an issue? do I need him to redo the I-864?

Also, and this may be the bigger issue; he has always used his parents address as his permanent mailing address, business address etc. until I come along with the whole visa process and now the bank and the NVC have his actual physical address. But his tax dude put the address on his tax forms as his parents!!! His mom is our co-sponsor, can I write a letter explaining what has happened or are we screwed?

what do I do? send it and wait for RFE? We paid the fee this morning. ACK!

I just called today, after putting it off for a few days because i kept hearing "no, no news yet" and found out that all my documents are in and im just waiting for my interview. She didn't say that my "case was closed" I don't know if that matters. However, do I still bother NVC with phone calls about my interview date or can I contact someone else ?? =) wooo, give us all interview dates ! MAY interview dates would be fantastic!

First off, his "current income" should be 2012 income. So there's no tax return/transcript yet to say his amount is incorrect.

As for the address, don't worry about it. When NVC is reviewing the tax return/transcript, they're just focusing on the $$$ amounts, not the other data. As long as his name and SSN match up (as well as the income he put on the I-864), it should not be an issue.

I'd call back and ask specifically: "Is all necessary documentation received and the case complete?"

As for calling about interview dates, you can now include DOS on your calling list. Both NVC and DOS will know when an interview is scheduled.

Quick question on the timeline feature. From other posts here it seems like the "packet 3" is the same as the IV packet, is that correct? Is that what's meant in the timeline here by packet 3? If so, why is it listed after case completed at NVC?

No, the packet 3 doesn't concern IR-1/CR-1 visa applicants at all. It's a package that is sent to K1 applicants from the embassy. It's similar to the AOS and IV packages combined, but with different forms. On your timeline, just leave this blank.

Current income is no problem, being self-employed he just lists how much he has made for this year.

But here's your issue:

Being self-employed your husband files a 1040 not a 1040EZ. He needs to use the TOTAL INCOME from line 22. NOT the adjust gross income from line 37. When they go to review his I-864 they will see line 22 will not match to what he claimed, and he will get a checklist.

Have him fix the blanks of the I-864 to show his TOTAL income for three previous tax years. (this can be a big difference from adjusted gross! Mine was in the thousands)

If he still falls short, you may need to consider a joint sponsor.

Page 8 of the I-864 instructions, second column, second paragraph:

"For purposes of this affidavit, the line for gross (total) income

on IRS Forms 1040 and 1040A will be considered when

determining income. For persons filing IRS Form 1040 EZ,

the line for adjusted gross income will be considered"
