very confused please help....

Hello everyone,

my fiance had his interview on FEB 09th in london U.S EMBASSY.My lawyer gave us a wrong affidavit of support form so the consulate asked for the correct form and some evidence that will support his Birth Certificate.So we sent out everything along with my fiances passport on Feb23rd but our problem was my fiance is living under student visa in UK.His visa will expire end of april and he needs his passport to make a timely departure from UK.so we emailed the consulate unit explaining out situation and they email us back after 6 days saying that my fiance will receive his passport within 5-7 days and our visa is in final processing.What does that mean??did my fiance get a visa or they are just sending him his passport back?I am very confused please help ..... :crying:

Little confused here. You told the consulate that he has to make a timely departure out of the UK in order to comply with his student visa, essentially implying that he's leaving the UK whether he gets his K1 visa or not. Is that correct?

I'm reluctant to believe that the consulate is going to feel any urgency in handling his K1 visa application just because his status in the UK is about to expire. They're more likely to think that if time was an issue then he should have waited until he'd returned to his home country to apply for a visa to the US. You never know, though. Sometimes you get a CO who actually has a heart.

It's hard to read between the lines and interpret exactly what they're saying. If they said he'd get his passport back within 5 to 7 days then they may have already sent it to him. Or, maybe his visa has already been approved and his passport is in the queue to get a visa printed. Dunno.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

It sounds like he was in AP at the embassy which happens often to non-UK born applicants. It's additional security checks. I know several from India and Pakistan who had an additional 4 weeks to clear the security databases. You didn't say where he is from so the AP is a guess. The delay from February is probably not just due to the Affidavit of Support issue.

Because they said it is in final processing, that indicates they have the AP cleared and are ready to send the visa for printing and then to the courier. If he was still in security checks, I think the letter would have said-- we don't know how long your additional processing will take. They might have told you they would return the passport and his visa file could be transfered to a consulate in the country of his birth.

Did they say VISA or did they say PASSPORT? You have asked for the PASSPORT back due to the need to travel, that usually means they will send the passport minus the visa. When AP is completed they will contact him and ask him to return the passport to have the visa put in it. They will not waive or expedite AP because your fiance needs to leave the country.

You also have made the assumption that they ONLY need what they asked you for. Not likely. They are probably waiting on other information from other countries to complete the AP.

I can't say, they are being purposely vague. I am no better with vague answers than you. I do KNOW they will not expedite or waive the AP process because he needs to leave the country. If they have already received everything they need maybe it is just a review and approval that is needed. And the passport will arrive with the visa. If not, they will return the passport and contact him to bring it back when they are ready to put the visa in it.

Hmmm I am so worried :( do you think if I call NVC on Monday they will be able to tell me what's going on.

The NVC doesn't process K1 petitions except to assign your LND number and pass it on to the embassy. The Dept of State will know if your visa has been issued.

i called the department of state today they told me administrative process is over but they cant tell me the decision yet :blink::help:

If the visa had been printed, they would know. Check each day until you know it's issued. Probably going to be soon.
