Hi. I literally need help. My conditional 2 years visa will expire in 8 days. We have no money to adjust my papers, the attorney is asking 3500 plus filing fees. I do not know what to do now. My case is very complicated. I got divorced with the man who petitioned me because of domestic violence. Right after divorce i did not adjust my paper coz i dont know how to do it plus i have no job and dont have money for the filings. I remarried last yr and give birth to a beautiful son last September. My question is what should i do? How can i file my papers? what procedure can i do within 8 days? Is there anybody who can give me advice in full details? please help me.

[*] 15 May 2013 - Moved from MN to LA; [*] 17 May 2013 - Applied for a new SS card/filed an AR-11 online (unsuccessfully), therefore called and spoke to a Tier 2 and changed the address; [*] 22 May 2013 - Address updated on My Case Status (finally can see the case numbers online); [*] 28 May 2013 - Letter received in the mail confirming the change of address; [*] 31 July 2013 - Went to Romania; [*] 12 September 2013 - returned to the US using the AP, POE Houston, everything went smoothly; [*] 20 September 2013 - Spoke to a Tier2 and put in a service request; [*] 23 September 2013 - Got "Possible Interview Waiver" letter (originally sent on August, 29th to my old address, returned and re-routed to my current address); [*] 1 October 2013 - Started a new job.

I would go see the lawyer. You should have removed conditions immediately after divorce proving you entered marriage in good faith. Now in 8 days you will be out of status and deportable, moreover new marriage might be a red flag here if not handled properly.

If you entered on K-1, you're supposed to marry the person who petitioned for you, and then adjust status. If you get divorced without adjusting status first, you are technically out of status. If you now have a new husband, you can file for adjustment of status, but your prior K-1 and failure to adjust status then will be a big red flag. This is tricky.

If you have no money to pay for an attorney, you should at least get a consultation with one. Some lawyers even offer a free consultation.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You need to try to remove conditions with a waiver, prove you entered your first marriage in good faith (prove with evidence) and at the same time explain why you are filing late. What to do with you second marriage I have no idea - lawyer will be able to help.

Some law schools run "clinics" and provide free immigration assistance.... but there is no way you will get their help "full" help in 8 days. Try finding a lawyer that will run down the basic steps for you, and also contact one of the free law school programs and what info if any they could provide. To be honest... you already messed up big time when you didn't file right after the divorce, and pretty much made yourself look horrible by getting married again so soon (two years.... and a baby is 9 months... so you had to have met your new husband REALLY quickly). My point is that without professional help in presenting your case a certain way you will most likely get denied. I am not trying to be mean, just pointing out that no one on this board or online guide is going to help you get approved (maybe help you get some time so you can get a lawyer later to help with an rfe etc... but only a lawyer is going to win this case).

The second marriage won't mess things up, but not removing the conditions on your residence will. If you can't afford an attorney, you will need to do it yourself. Follow the guide. Download the forms. Ask questions here and you will get help. Somehow you need to get this done.

You will lose your permanent resident status and be removable if you dont get it filed by the 2 year anniversary.

Thank u so much for letting me know that my second marriage wont affect my visa. And thank u to all of u who replied. Yesterday i got a hold of an atty that is willing to work on my case with a payment plan. Im so thankful about it.. Now my question is.. Does my ex husband letters in the past asking me to marry him will help me prove that i entered the marriage in good faith?? And if there is anyone here who have the same situation lile me. Please let me know what happen after filing the papers?
