Police report not clean, should I worry?????

How could a person not remember they had been in prison? Somehow this should have been a conversation you'll had on the 2nd date, even before you thought about filing.

he didn't disclosed it in the papers since I made the aplication and I didn't know about it......

So sorry to hear that...it was a horrible oversight on his part though. He may be denied the Visa and a case of misrepresentation made against him. This is a very serious charge if it sticks! You may want to start searching for a top immigration lawyer to review your options. I wish you guys luck...

Oh sorry, no time served but convicted without time served, agian this should have been discussed BEFORE filing the petition.

The IV application asks if he has ever been arrested, charged or convicted not just if he's served jail time. If you answered "no" on this you have a very serious problem.

If you answered "Yes" you'd might be ok in the end, unless it's considered a crime of moral turpitude in which case you'll need a waiver. If he beat up his ex wife, i'm not sure how easy an "extreme hardship" waiver would be.

Btw, you aren't supposed to fill out the IV application, he is. Who signed it?

Just to be clear, the petition stage asks not questions about the foreigner's criminal record. It's later when competing and signing visa applications like the DS156 an/or DS230 where these questions are asked. I does NOT matter who fills out ANY forms, so if the USC filled out the visa applications without asking the questions about the past on the forms, that's "foolish". Where it becomes a real issue is when the foreigner signs those forms with false answers. It opens the door to a legitimate finding of material misrepresentation which if found and upheld, can result in a lifetime ban from entering the USA.

The standard for the finding and penalty are pretty high, but the door is definitely open if these questions were incorrectly answered on a signed visa application.

Facts are cheap...knowing how to use them is precious...
