Police report not clean, should I worry?????

I wrote befor about how the consulate requested his police record from Spain and is not clean he was convicted but without serving any time in jail and this conviction ended in 2011 but can clean the police record until 2014, the conviction was for abuse he beat his ex .......the interview and relationship was proven but they asked for this police report........now is this going to be a problem at the consulate?

Does anyone had a similar situation?

Please help.

I think you should tell us a bit more on the background, you are the petitioner I suppose? And he was in Spain, like most Romanians, working illegal jobs? I think you can ask for a waiver, but are you sure ....?


USCIS [*] 22 Nov. 2011 - I-129 package sent; [*] 25 Nov. 2011 - Package delivered; [*] 25 Nov. 2011 - NOA1/petition received and routed to the California Service Center; [*] 30 Nov. 2011 - Touched/confirmation though text message and email; [*] 03 Dec. 2011 - Hard copy received; [*]24 April 2012 - NOA2 (no RFEs)/text message/email/USCIS account updated; [*] 27 April 2012 - NOA2 hard copy received.

NVC [*] 14 May 2012 - Petition received by NVC ; [*] 16 May 2012 - Petition left NVC.

EMBASSY [*] 18 May 2012 - Petition arrived at the US Embassy in Bucharest; [*] 22 May 2012 - Package 3 received; [*] 24 May 2012 - Package sent to the consulate, interview date set; [*] 14 June 2012 - Interview date, approved.

POE [*] 04 July 2012 - Minneapolis/St.Paul. [*] 16 September 2012 - Wedding Day!

AOS/EAD/AP [*] 04 February 2013 - AOS/EAD/AP package sent; [*] 07 February 2013 - AOS/EAD/AP package delivered; [*] 12 February 2013 - NOA1 text messages/emails; [*] 16 February 2013 - NOA1 received in the regular mail; [*] 28 February 2013 - Biometrics letter received (appointment date, March 8th); [*] 04 March 2013 - Biometrics walk-in completed (9 out of 10 fingerprints taken, pinky would not give in); [*] 04 April 2013 - EAD/AP card approved; [*] 11 April 2013 - Combo card sent/tracking number obtained; [*] 15 April 2013 - Card delivered.

[*] 15 May 2013 - Moved from MN to LA; [*] 17 May 2013 - Applied for a new SS card/filed an AR-11 online (unsuccessfully), therefore called and spoke to a Tier 2 and changed the address; [*] 22 May 2013 - Address updated on My Case Status (finally can see the case numbers online); [*] 28 May 2013 - Letter received in the mail confirming the change of address; [*] 31 July 2013 - Went to Romania; [*] 12 September 2013 - returned to the US using the AP, POE Houston, everything went smoothly; [*] 20 September 2013 - Spoke to a Tier2 and put in a service request; [*] 23 September 2013 - Got "Possible Interview Waiver" letter (originally sent on August, 29th to my old address, returned and re-routed to my current address); [*] 1 October 2013 - Started a new job.

Well I'm the petioner, and he is in Romania, he was in Spain for 5-6 years, and no he wasn't working illegaly he was legal there he just had an altercation with his ex wife in 2004 but is recorded on his police record, however the conviction expired in 2011.........

Not sure what else to write....

I think he will be fine. By the way did he have to go to Spain to get the report or he just jent to the spain embassy in Romania?

It will depend if what he was convicted for involves "moral turpitude" as defined by the immigration law. If it does then he will be found ineligible but you could file a waiver.

CR1 Visa

USCIS STAGE: 16 days No expedite request but USC residing abroad
NVC STAGE: 19 days from case # to case complete
03/27/12: interview at Paris embassy - APPROVED
04/12/12: POE San Diego

ROC
01/15/14: sent I-751 application

05/14/14: received card production notification by e-mail, approval date 05/13

Naturalization

02/01/24: N-400 submitted online; Biometrics reuse notice received immediately online; "case being actively reviewed" after a couple hours

02/09/24: received NOA1 by mail

02/10/24: received biometrics reuse notice by mail

04/08/24: interview scheduled for 05/14. Received "We have taken an action in your case" email.

05/14/24: approved at interview, same-day oath ceremony in San Francisco 🥳 🇺🇸

 

Passport

06/10/24: application submitted at post office for passport book and card, paid for expedited processing and shipping

06/24/24: received email notification that passport was approved, then shipped with tracking number

It will depend if what he was convicted for involves "moral turpitude" as defined by the immigration law. If it does then he will be found ineligible but you could file a waiver.

I guess it all depends on how the consul see it fit.......would it help if I go to the interview?

Also I have the Congressman and Senator send letters for us at the Consulate, does this helps??

Why do they know him? Is there something they can say about the charges.

Don't expect those letters to bear any weight in evaluating his criminal record. They don't know him. It will be what it will be. You provide the police report and see what they say.

No and no.

It's not how the CO sees it, they have guidelines to follow about what is a crime of moral turpitude and what is not. A while ago someone had posted a manual about it here but I can't find it. I can only give you that link http://en.wikipedia.org/wiki/Moral_turpitude

I believe he disclosed this on his forms if indeed he was required to...

If he did not, then that's a separate very serious issue.
