Thanks--Here it goes:

Our household family size is 6. Me, my wife and 4 kids. My wife overstayed her greencard because of her mom's illness as she was taking care of her and that's why I had to start over for her to get her GC. Returning Resident visa was not an option as told by the US embassy there. My wife and I have been in Pakistan since October of 2008. I have returned back along with my daughter 18 months old. My wife still has a 4 month old daughter, who is a US citizen. My two sons ages 7, and 5 are living with my parents in Atlanta since 2008. My father claimed them on his tax returns for the past 2 years.

We have been unemployed for the last 3 years and my father-in-law in Pakistan is basically taking care of our needs and supporting us financially.

Now, I am back in the States and have applied for a job with the county here in Atlanta. In couple of months time, I will have a job if everything goes accordingly, with an income of 34K+ a year. I am hoping to get a conditional offer letter by the time my wife will have her interview. Infact, I am planning to accompany her at the interview.

Meanwhile, I have a joint-sponsor ( my uncle from Florida) who owns a business and makes around 100k net profit approx.) He will submit all relevant docs such as 3 years of tax return w/pertinent schedules+ business license+ naturalization certificate+Recent bank statement.

My Uncle also has offered to give me an employment at his franchise with similar income bracket- 30-32K.

Dad is giving me 25-30K as a money to include in my assets in I-864. He is gonna write a notarized letter stating that he has given me this amount so I could use it to establish myself here and get myself going here. I am also gonna include a letter of my own notarized the reason for not filing last 3 years of tax return ( US & Abroad) since we had no income nor we owed any back taxes and stuff. I am also including pages from IRS publication 17 which gives a table of who can file for what minimum income.

Do you think, they will accept my AOS based on what I have just told you?

So, the IV fee bill has come out of the bank but has not yet shown as paid on the website. I'm sure it will soon.

I do have a bit of a dilemma though, do we try and send in additional evidence with the DS-230 or not? I believe that as long as our 200+ pages of evidence didn't get dropped on the floor between USCIS and NVC and then on to GUZ, we ought to be fine. Hell, if that much evidence doesn't do the deed there isn't anything in this world that would (short of us living together with two or three kids).

So really, I'd be resending what was already sent with a possible addendum. The wife says "skip it". I tend to lean in the same direction since I really don't know what more we could send. I may take another look at the size of the PDFs for the master evidence files and see if I can squeeze them into the 10MB limit. Such a silly small limit when you think about it...

FWIW, I pondered whether or not I should send extra evidence to the NVC. I ultimately decided to only send what they asked for.

Do you think, they will accept my AOS based on what I have just told you?

With everything you're submitting, it sounds like they should accept your AOS package. But I don't know much about complex cases as yours.

Just make sure you and your joint sponsor fill out I-864 forms, include his tax information (try to have him get tax transcripts as they're much preferred by NVC), his naturalization certificate, your letter about why you haven't filed taxes, your dad's letter on assets, include a bank statement as well showing proof of such money in your bank account.

Friday morning I believe. I was shocked to see it show up out of the bank account early this morning. Caught me unprepared I must say.

I think we are all at that point. I am trying to get mine done asap to not have to wait till May interview, I am really hoping April so that we can celebrate our 1 year anniversary here!

Saylin, oh guru of the NVC, please add me to your spreadsheet. Our NOA2 date was March 2.

I've read over the FAQs and most of my questions have been answered.

But we have hit a speed bump.

I asked my sister, our joint sponsor, to get some more documentation together. What I asked for was her 2011 tax returns and W2s, 2009 and 2010 W2s because she forgot to give them to me with her tax forms, and for her to re-print and re-sign the I-864 because the one I have will be over six months old by the time we have the interview. I also gave her the IRS link to get transcripts, so if she didn't want to dig up the W2s it wouldn't be an issue.

My darling sister acted like I was asking for her to move mountains and told me "I really don't have time for this"

Well.. OK...

I found another joint sponsor. We've come too far to be held up by someone who wants to be selfish. I don't have the time to mess around and kiss her @$$ to get what I need. (she's getting a lump of coal for Christmas this year)

Our new joint sponsor makes well above the poverty level for the household size. All of his income is from Veterans compensation and pension. With in an hour he sent me the letters, they are all printed on Department of Veterans Affairs letter head and have a signature of the director of benefits assistance.

Q1. Is all sufficient? (it might even be over kill lol)

1. Letter stating the amount of pay he receives every month

2. Letter stating his rate of compensation for a service connected disability and the date he started to receive compensation

3. Letter stating he was honorably discharged from the United States Marine Corps and his dates of service

4. A print out of his pay spanning March 2009 to March 2012.

5. A letter from him stating that VA compensation and pension payments are non-taxable income, and as his only source of income he has been exempt from filing tax returns with the IRS.

6. a certified copy of his long form birth certificate

Q2. Does he claim his wife in household size if they are legally separated and living in two different states?

Q3. Question 22 asks employment, Would I check a. Employed as/an and fill in Disabled Veteran or would I pick d. Unemployed? He is not self-employed or retired.

Q4. Question 25 about tax returns and the amount earned in the previous tax years, since he does not file a tax return would I leave all that blank? Or fill in the amounts with out checking the two boxes about tax returns?

As for the wife question, I believe yes, if they're still legally married and not divorced, she'd be counted, as he would put '1' in 21c since she is technically still his spouse.

For employment, he's technically not WORKING, so, I think that would be out. IMO, I think c (retired) might be the best option, and put US Marine Corps as the company name.

Since he hasn't filed tax returns for those years, I think you might leave the entire question blank.
