K-3 VISA CHILD OF SPOUSE

Hello everybody. Need some serious help on this. I sent the I-130 application for my spouse who lives in Colombia, on Dec 2011 to Chicago, but did not send the application for her daughter, 11 yrs old. I sent the applications in separately, about 2 months apart. Is there anyway the applications can be kept together even if it means delay or are there going to be 2 separate interviews if the applications get approved? Anybody that can help, I would appreciate it extremely.

First, the I-130 is a petition, not an application for anything. Second, an approved I-130 does not enable a K visa application. Your spouse will apply for a CR1 visa and the step child will apply for a CR2 visa. (Unless you've already been married two years, then it's IR1 and IR2.)

The cases can be joined together once they are both approved by USCIS and have new BGT case numbers assigned by the National Visa Center. Between now and then, you could try, but I don't think it would be worth the time and effort. I would just hold on trying to join them until you have two BGT case numbers to communicate with NVC about.

Facts are cheap...knowing how to use them is precious...

if you have both NOA-1 notices, with seperate receipt #'s -

it is possible to join them up at uscis.

you'll need to call in to USCIS hotline, get / ask for an ISO,

and inquire about it.

CAVEAT - unless the child's case is pulled FORWARD to the Mom's case, expect the Mom's case to be pulled BACKWARDS in the queue to the child's case.
