How to withdraw denied k-1 petetion

Timeline

Any one know how to withdraw denied k-1 petition before it was send back to the state from foreign US embassy. I am ready to file for CR-1. Should I withdraw the k-petition first or just go ahead with CR-1

Add a withdrawal letter for the previous I-129F filing to the I-130 package. Be aware though that marriage, in and of itself, does not erase the reasons for the K1 visa denial.

you're going through one of the toughest consulates. The K-1 denied, now needs the CR/1 visa. know the reasons for the denial.. keeping in mind filing the CR/1 does not guarantee the visa. be patient.

hw do you intend on resolving the issue with you and your fiancee having the same last name? was there anything else that was cause of denial? did you offer or plan to provide docs like dna/blood/birth certificate/school history/address history samples/your parents to children(you guys) dna sample? as pple mentioned, this is lagos consulate, they can still look at it in different ways. for example, the CO might now think you were previously married before and then you took a oath and lied that you were engaged. OR, this is another way to bring a family memeber over. You want a crazy idea: maybe marry in Nigeria, live there for months, have a baby together with your spouse, and then provide baby dna to prove. again, crazy idea, but i think thats the extreme length, and even then, it doesn't guarantee the CO will agree and give visa. because again, its Nigeria and unfortunately we would fraud any way possible to visa. really think it through.. sometimes its not the money invested, but the time and energy. all da best.

im generalizing and not pointing anyone out... and that is the view from the consulate and even outsiders, right? or you want to tell me why lagos consulate is so tough, if not the toughest? its a shame cuz it bothers me to, but thats just a fact now.

a CR1 voids a K-1 petition is true... but again, if you don't handle the reason why you were denied, what purpose will it serve when it comes up again. like someone said on anoda couple's outcome, immediately suggesting to go get married is not a guarantee. he was denied due to same name with fiancee, so how do u suggest he treats it? just getting married? as much hard/hurt as it can be, sometimes we hv to put ourselves in the seat of the CO. thats the only way one can begin to prepare to defend any red flags. one of the interesting interview review i read on Nigeria country portal was a lady who right after taking the oath, they already had their red flags listed out and even addressed it with the CO. i mean, if its obvious, why act like its hidden?

if the reason for your refusal was based on you bearing the same last name with your fiancee marrying him/her is not the right decision but writing against the decision and addressing it to the consulate general office in lagos telling them the CO decision on you was unfair and that you will like them to reschedule another date for you.

Too late for this. They are married now, so not eligible for a K1 visa anymore.
