Got report for 14 days overstay what to do

I got a report for 14 days overstay my b1b2 visa, now I am applying for CR1,the one who reported me was from US goverment fraud dept.

How bad it is? will they denail my visa and ask me apply for waiver?

please help

Since your overstay was less than 180 days, you have not incurred a ban and will not need a waiver. With that being said, you may be questioned about it at the CR-1 interview so be prepared to answer any questions a CO may have about it.

December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

While you have not incurred a ban because of the overstay, you have still been flagged and that could create other issues. I don't want to give you a false sense of security; therefore, the best suggestion I can give you at this point is to have a consultation with an attorney well versed in issues like this. Since you are the beneficiary, your USC petitioner may want to have the same consultation.

Sounds like you're looking for somebody to tell you what you WANT to hear. Somebody might, but they would be speculating. The Consular Officer is going to consider the totality of circumstances surrounding your case. None of us here, know all those circumstances. In and of itself, a 14 day overstay is not a reason to deny a visa but if the CO thinks you being in the USA is more important to you than your marriage is, then you have a problem. Overstaying is not good and IS an indicator of potential fraudulent intent. Whether you have sufficient positive evidence to overcome that potential concern will depend again on the "totality of circumstances". You are just not going to know the result until the interview has concluded.

Facts are cheap...knowing how to use them is precious...

From my understanding (From what I've read) the waiver is form I-601 you can download it online it has a $565 fee and you are told at the interview whether you are eligible or not from there they review it, with the I-601 you have to show evidence of extreme hardship on the US spouse if the applicant isn't able to go to the US. from there they either aprove it or deny it after it been reviewed.

April 2007- Met while I was in sophomore year in high school by his house

December 16th 2010- engaged

May 28th 2011- married in Sāo Paulo<3 <3

July 13th- Sent I-130

July 15th- I-130 received

July 18th- received NOA1

August 1st - touched

Sept....Oct..Nov...Dec...Waiting -__-

January 24th- received NOA2 via email

January 27th- recieved NOA2 hardcopy

February 1st- NVC received

February 7th- got my case number

February 7th- got the IIN number

February 10th- payed AOS fee

February 14th- AOS PAID!

February 15th- payed IV fee

February 16th- IV PAID!

February 23rd- sent AOS & IV packages to NVC

February 24th- packages delivered at NVC

February 29th- recieved checklist

March 5th- sent back checklist items

April 30th - interview

I can answer your question, since I was looking for this answer before.

overstay more than 180 days need to apply for I-601 Which called hardship waiver, usually when you go to the interview and you get denail CO will ask you to apply for this waiver.
