Need co-sponsor or not ? Plz help !!

I am getting the affidavit of support for my fiance for him to bring to his interview. I went to my lawyer today who was being very rude, he told me that I do not need a co-sponsor for a fiance visa although I made only $9200 2010 working August to December. He said that I will not need a co-sponsor until my fiance gets here and is adjusting his status...Could you guys please tell me whether or not I will need a co-sponsor ?

K1 IS a non-immigrant visa, but it's considered part of the IV(Immigration Visa) unit at embassies. However where you're interviewed doesn't really matters, it matters that K1 is a non-immigrant visa with immigration intent. Your lawyer has something mixed up there.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

ok, so does this mean that i will need a co-sponsor, because the lawyer was saying i would only need one for a non-immigrant visa...?

I could be wrong, but i believe K-1 is non-immigrant (in itself). Upon approval and arrival and marriage, you apply for adjustment of status to immigrant (permanent resident). So therefore, i believe K-1 is technically non-immigrant in itself.

Isn't it tax time now? Wouldn't it go by your 2011 taxes now... My fiancé just got his taxes back for 2011 and I will need a cosponsor seeing as he made only 11000 this year and we are a family of 4....

It is tax time and usually you get your W-2s at the end of January. But everyone in the states is case by case on their taxes.

It is mandatory to have your taxes done by April 17th unless you file for an extension.

If you have done your taxes for 2011 then you can send those, but if you have not then the US embassy will still accept the 2010 because we have not passed April 17th.

I think you are wrong my friend. I Googled several links like the one below and they back up what he posted. It is for foods stamps, it is based on income requirements for a K1 ISA petitioner. If you don't meet them, you need a cosponosr. No cosponsor, no VISA. I witnessed it when I was at the US Embassy in Manila during my fiancees interview baxk in 2010, when some beneficiares petitioner did not meet tthe minumum requirements. THey will not let anyone become a public charge to the U.S., hence that is why there are income requirements.

USCIS has same $14,710 for family of 2. this is multiplied by 1.25 to make $18,387 for family of 2 in lower 48 states... as my prior post stated.
