Hi everyone,

I hope you can help me with my dilemma. Here Goes:

I have applied for my ROC March of last year and got approved September of last year. The approval letter that I got states that if I have not receive my 10 year gc within 60 days is to call and verify. 60 days had passed and called and USCIS told me that hey have already sent my card October of last year. They have even provided me a tracking number and it says delivered. The problem is, I have not receive any letter from USCIS in the mail and I have also did an inquiry at the USPS and they said they couldn't track it anymore. Now, USCIS said that the card was not return to their custody and considered lost, so I have to file for an I-90 for a replacement with a fee of 480 bucks. The process will take up to 6 months according to them (USCIS). I do not think it is fair that I have to pay this amount as it is not my fault that I have never receive my card. Any insights on this? My other concern is, by March of this year I will be eligible to file for my citizenship. Is it a smart move to just file for my citizenship and not the I-90 anymore for the replacement of my 10 year gc that way I do not have pay 2 fees? Will the approval letter that I got will be enough proof that my petition to ROC has been approved and just didn't receive my card?

April 7, 2008 - sent I-129f to VSC

April 10, 2008 - VSC received petition

April 18, 2008 - NOA1 hard copy received

May 9, 2008 - touched

July 14, 2008 - touched

July 15, 2008 - NOA2 (99days)

Aug.14-15,2008-Medical PASSED

Aug.22,2008- Interview PASSED (Pink Slip Only)

Aug.29,2008- VISA ON HAND

Sept.3,2008- POE Houston TX

October 25, 2008 - Officially Mrs. Eaton

AOS Timeline:

March 10, 2009 - AOS package sent to USCIS via FedEx

March 12, 2009 12:21pm - AOS package delivered to USCIS

March 20, 2009 - Check cashed

March 21, 2009 - NOA1 for I-485, I-131 and I-765

March 24, 2009 - Received Biometrics Appointment

April 4, 2009 - Case transferred to CSC

April 7, 2009 - Biometrics appointment is done

May 4, 2009 - AP approval notice received

May 8,2008 - EAD received

June 3, 2009 - Welcome notice from CRIS via email

June 8, 2009 - Receive hard copy of welcome notice on the mail

June 15, 2009 - Card production ordered

June 27, 2009 - Green Card on hand ( 2 years )

Beats the hell out of me with anything we ever received from the USCIS or the DOS came in first class mail, completely untraceable. Kind of at the mercy of your IO if you bring in proof that indeed your card was lost, should make an infopass appointment and get either a I-94, bring in two passport type photos or your foreign current passport for an I-551 stamp.

If you applied for US naturalization 90 days early and received that one year extension notice with your I-751, your dates should be very close. But with that I-94 or I-551, you are here legally. We were fortunate to get that ten year card only ten days before my wife's interview, only to have them take it back. That was great news for us as we saved another 450 mile round trip and another loss of a days pay. See some others on this board received their US naturalization without ever seeing their ten year card.

Really don't like going to the removal of conditions section of this broad, same old ####### and same old problems, brings back too many bad memories and major stress.

Well, that was the first answer you got (to pay monies, get a new card) from a USCIS human . Was it a CSR or an ISO?

There are members' stories here of successfully getting a replacement without paying the fee. One had to be adamant, though.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
