Arrest and filing for N-400

I am LPR. I was arrested for A & B. Given the ridiculous circumstances, I was given a 9 month general continuance and told it "wouldn't effect my immigration status", and the case should show as 'closed' in October.

BUT, I want to file N-400 before then. Has anybody else had these circumstances? Is this going to be an issue? Am I likely to get denied?

Any info is appreciated.

I'm guessing Assault and Battery which regardless of the circumstances is going to be viewed in a very negative light. IMO it won't make much difference whether the case is closed or still pending in the court system. It will come up in the review of the N-400. I have seen instances of people getting denied and even getting their citizenship revoked for lesser charges. Not trying to cause any panic but I think this is one of those cases where you need to consult an immigration attorney.

I have no intention of lying about anything. I was also asking in case another VJ'er had experienced something similar, and what their outcome was, OR, if somebody knew the process well enough to be able to comment. But lying, no.

Not kidding on this, stepdaughter got a decision cannot be made at this time due to some pending charges against her. Week later, we got a letter for her to respond to assault and battery charges with the dates and the place of the incident. Just saying, the USCIS does check on things like this.

But wasn't very difficult to prove she was in Venezuela at the time and was 17 months old for the first incident and barely four years old for the second. Didn't even respond to the USCIS, just gave that to my senators office and they took care of it.

Bet whatever you did, bet you wish you didn't do it. Hell, my ex wife was a bear to live with, could have snapped her neck in a half a second and killed her. Instead just let her pound the hell out of me, throw stuff, called the police and had a restraining order placed upon her. Never raised a hand, and was really helpful in getting full physical custody of my kids. Have to learn to control yourself.

A & B is a crime of moral turpitude. If you file for naturalization now, the I.O. will put your application on ice until the exact outcome of the charges and presumably trial are documented. I would advise you to wait and see what the verdict is.

Thanks Brother, the case isn't going to trial. The DA made a deal and I was given a general continuance - i.e do nothing wrong for 9 months and the case is considered closed. To the best of my knowledge, it will still show up next to my name in files, but 'closed' will appear next to it. I am not 'convicted' as such, and there will be no official notice of such. Only of the initial arrest.
