Timeline

So i stated in an earlier topic that my ex pressed charges against me for domestic v. but last day my lawyer called my and told me that the case was DISMISSED AND CLOSED!!

now what do i write on the NOA2? shall i declare it or should i just mark NO on all of the crmininal question? i have a clean record.

If the Case of DV was Dismissed and Closed it is not a Conviction. Also, there is nothing you write or explain on a NOA2.

A dismissal is not a conviction, if they ask for an arrest say yes and include the case disposition ( certified copy). If you were never arrested and a case was filed i.e. a criminal complaint, and dismissed then you have nothing on your record. In any case I would get a certified court copy of it.

This is my experience for a K-1 I-129f approval as the petittioner.

Get the certified paper work from the court ahead of time just to be safe. If the disposition shows closed/dropped/abandoned the USCIS will know what that means and you will not be given an RFE on it (from my experience). Check "No". Do not send anything in on it being proactive. Since there was no conviction or court case, I do not think they can mention this to your fiancee but I wouldn't count on that. Your fiancee absolutely has to know about this in case they ask. I am explaining my situation in detail to my fiancee and how I was railroaded courtesy of my ex.

My I-129f/NOA2 was approved in exactly 4 months. No RFE. You are good to go.
