CR-1 - Couldnt Find the USC

Hi everyone. A friend of mine was having a problem finding his husband here in the US. Its been, I think 6 mos. since their last communication. Her husband petitioned her and it was approved I think in 2009. It took a while before they were able to submit all their documents for DS230 and supporting docs. By mid of 2011, NVC sent a mail to her husband here in the US regarding some documents needed to proceed with the visa processing. She doesnt know what documents are needed so she decided to call the NVC here and the operator told her she only needs DS230 Part 1. She just mailed it to NVC few days ago and still waiting to confirm if NVC received it.

My question are:

1. Can she still come over here knowing her petition was approved but she couldnt get a hold of her husband?

2. I saw some information that some documents have lapsing period especially the affidavit of support. Does her husband still need to submit his affidavit?

3. What does she need to do?

All I have to say is, this has got to be one of the weirdest things.

Does she know any family members? If he abandoned her, which sounds feasable, her attempt to come over may be unsuccessful. However, how anyone in their right minds abandon a spouse in a foreign country is beyond me.... but...

If she is really married and concerned about him, hire and PI, locate him and see what is what, seems like unless he is dead or injured, he changed his mind. So then you do not have a continuing relationship/ marriage etc., USCIS will decide that.

regardless of the RELATIONSHIP, a Supervisor can tell the BENEFICIARY, the VISA APPLICANT, the status of the casefile. It's allowed, even.

It seems the applicant is more interested in coming to US regardless of being with spouse or not.

She has not been in touch with her spouse for 6 months, yet seems she is more interested in how to get the visa and comeover.

Logically won’t it be the first step for applicant to get in touch with his family, his employer and figure out whats going on rather then what she needs to get visa.

Won’t CO be asking at the interview when was last she communicated to her spouse?

I agree with all of your points, but I shove them into the 'later' category - things to do AFTER learning the status of the NVC document intake at NVC, with a NVC Human.

She may find out the I-864 was withdrawn, for example.

This situation is a sad one. I hope everything turns out ok for the OP's friend. The OP's friend should really focus on finding out what happened

to her husband first. Everything else she does now is really a moot point without the husband.

Yea that could have happen, in that case of her trying to file for visa and coming over just does not make sense.

She definitely needs to find her husband before she proceeds whether or not the Affidavit of Support was withdrawn. It's a rather strange situation. Sounds more like they are separated than married.

As the beneficiary, she can contact NVC to obtain information about her case. That's the simple part.

How the hell do you not have contact with your spouse for six months? This raises questions as it is not normal.

Imagine the interview: When was the last time you spoke to your husband, the person petitioning for you? Six months. = Visa Denial

omg 6 mos. without communication? thats weird and i cant imagine my hubby not talking to me that long, why dont she investigate ask family members of his hubby's where abouts or whats happening and yeah all comments here are true how can you established bona fide marriage if your hubby is missing and wont even bother to csll you in 6 months!

Wow, I can't imagine not hearing from my husband longer than 8 hours, after a few days I'd be worried.

This is what bothers me the most. After a few days, even a week or so, and I did not hear from my wife I would be burning up the phone lines trying to find out what happened. 6 Months? And now she cannot locate him? This is a relationship? Something is very seriously wrong here.

She should get any contact number from her husband family and their address in case of emergency.....now she gets a lesson to not just jump to marry a guy from somewhere with out knowing him....

At the risk of sounding judgmental, if in 6 months this person has not sought to track down their spouse, but managed to dredge up a number to NVC it is clear what is taking place. You can google most USC, call their place of employment, or send the police to their last known address if you suspect foul play, but those things would require caring about them. I'm sure your "friend" sent you swimming for answers without giving you all the details.
