Denied Spousal visa CR1 in Casablanca

As I previously stated, no; approved spousal visa petitions do not expire. When a spousal visa petition is sent back by an Embassy or Consulate, there are only two possible outcomes once it gets back to USCIS and I spelled out those outcomes in my previous post.

When a fiance(e) is sent back by an Embassy or Consulate, there is a third outcome that is in addition to the other two I spelled out and that third outcome is "the validity of the petition expires and USCIS takes no further action on it." Majority of the time, this is the outcome that most couples encounter when a K1 visa is denied and the petition is sent back.

Hey OP. it's going to take an average 6 months for your wife to receive a NOIR in the mail. NOIR= Notice of Intent to Revoke. It's SO SO SOOOO important that she answer it in the time that USCIS gives her. In the NOIR, they will list the reason for the denial, and it's your job to prove them wrong in order to get reaffirmed.

I know several people who've been reaffirmed that interview almost exactly one year after their original denied interview. This seems to be the norm with Casa. Let us know what the NOIR says when your wife receives it, perhaps we can help with the rebuttal. Good luck, khouya.

From what I understand Casa is Hard. I hope you front loaded your petition with proof cause it looks like they do not accept the extra proof at the interviews. But even some that have front loaded get denied.

Do not worry. Just practice answering questons to any red flags you might have.

Married on first visit

in person together only a few weeks-they like it when woman lives with man in morocco a couple few months

different religions

family does not approve

Only 1-2 visits to morocco

need daily contact or frequent

If you did not front load-do not worry. YOu will have a chance to send more evidence with the DS230--and I would. Cause I believe the Counselor will look at that evidence.

Do not worry. Just prepare. Have him know EVERYTHING about your family, job, kids, nephews, neices, fathers job,send him pics of where you live and what you hme looks like. Talk alot with him.

You will do fine as long as he knows everything and if you can...go to him for the interview. I do not know if they let you in but have him take your passport in with him to prove you are there.

Ihad interview in casa Dec 2009 k3 ihad interview 2times and igot 221g same as u them our case have been back to uscis we didnddt hear anything till after 7months or more uscis asked us to send more proofs that we still togther and we did and after uscis got our proofs they email us and said that we should hear something before 45days but we didnt after 5months or more uscis denied our K3 and now we start CR1 and we still waiting NOA1 listen to me brother ur wife must call nvc and tell them that ur CR1 visa have been refused and ask them if she can do new CR1 with old I130 bcz we havee been told when our visa denied but our I130 have been more than year cus I130 its valaible for one year. dont give up brother cus that the consulate of casa try to do when they refuse ur visa Good luck.

No, not at all. There's more process, after the casefile has left the IV unit abroad.

i advice you to move and go to the consulate of casa and defende your case and talk to the Consulate Officer... but you have to write down a letter and your partner too explaining your case and the reason why they took the denial. do it before your case will be sent to the USCIS

i advice you to move and go to the consulate of casa and defende your case and talk to the Consulate Officer... but you have to write down a letter and your partner too explaining your case and the reason why they took the denial. do it before your case will be sent to the USCIS

I would appreciate any help for my situation

My spousal visa CR1 got denied in Morocco, Casablanca. How much time does the USCIS take to review the case again? I heard that it might be 6 months and other members told 2 years.

Hello I'm sorry about you denial casa is such a hard consulate! my husband and I had the same thing happen in 2010 he was denied at his cr-1 interview it took 7 months before we heard anything and then we received our noir, which that is when you will find out the reason(s) for denial. Then finally in December 2011 had our second interview it was at 3 and yes it was an interview it was much smoother and approved!

It will be awhile just make sure that your senators office is on top of it with you they truly can be a huge help come time to send in your noir and you will only have 30 days to put it together, not even because you need to allow time for the paper to come in the mail and time to send it back so what I would suggest is to just start putting proof of relationship together don't over due it though with pictures, have family and friends write letters that have seen you together and can tell them how you are together! and then when the noir comes be sure, like somebody said earlier to address every reason they give for denial and be sure to think about the interview, write the whole interview down and think for yourself what might have caused an issue!
