Alternatively, if you're at least on civil terms with your soon-to-be ex-wife, it can't hurt for you to file for the I-751 jointly. Obviously I don't know whether or not this divorce is acrimonious, but if she still likes and respects you to some degree, you could / should still file jointly so that the pending divorce isn't even a part of the USCIS discussion at this stage.

Or, even though this might be a little far-fetched, could your wife possibly be persuaded to delay filing for divorce until after your green card processing goes through? Again, I don't know the dynamic there, so that might be a tall order.

That would be immigration fraud, relationship to gain immigration benefits. If they're going to get divorced they should get divorced. What if they have an ROC interview. Fake it?

i always have bad luck.

immigration is not so much about luck, but more about qualifying honestly for immigration benefits.

you successfully AOSed. very good! it seems that you both entered in to the marriage in good faith. if you have evidence to prove this and evidence that you lived together as a normal married couple (ie financial co-mingling), you will be able to do a waiver for ROC and file on your own. you will likely have an interview, but neither you or your wife have done anything wrong (as far as you have reported) and a failed marriage is pretty sad but it doesnt mean that you will have to give up the life you have built in the US.

so even though i dont believe in luck, i wish you the best of it!

ps. also, i agree with vanessa. do not engage in any kind of fraud no matter how harmless it may seem.

I don't think it's immigration fraud. If the divorce papers haven't been filed, and it's a legitimate marriage, then there's no fraud going on.

It looks like this particular marriage is going to end no matter what, but if I was in the same situation, thinking about divorcing my wife but knowing that doing so before she filed for her 10-year GC could cause her a great deal of hardship...well, if I still respected her and knew her intentions for the marriage and coming into the country were sound, I would hold off until the process was done. It's not fraud -- it's maintaining the relationship from a legal standpoint. Lord knows the USCIS doesn't ask for proof of love...

but the USC in this situation has stated that she wants to end the marriage as soon as possible. delaying that for the sake of immigration purposes would be viewed as fraud by USCIS.

i know, it's a fine line. but since the package has not been sent, i would re-assemble the packet with the waiver and go from there. then there is no possibility of fraud being an issue.

u guys are right..I would just love to not make it longer if I apply my self and not having to go to interview.

I dont believe in luck either..but seriously, millions of people confuse persian with arabs or with the persian goverment so we DO get run over at airports and things regarding immigration I kid u not..heh dude I could have shown video of 3 year long real relationship they still given me hard time... and then it might look wierd maybe if I get a divorce right after getting the 10 year GC :/

aaaaaaannyway..probably best to be more than just little honest.. i mean apply by my self..hell I have millions of images even a paranoid person wouldnt hesitate..I think it will go well after all!

I have a buddy who is arab and works for the US Government, he used to wear a backpack all the time, now he carries a briefcase and wears a tie and got rid of the backpack, he is treated completely different.

You are overseas now with a GC that expires in 2 months? My mother went home to Canada with 4 months left on her GC and when she came back they gave her a hassle because the card had less than 6 months remaining on it. Same with passports, they want it to have 6 months left for some reason. Just a heads up that that may be a question upon reentry.

Actually I got back to US without any problem, thank god!

Well I'm not sure you can call it being back together again but..at least now we're not fighting however I'm staying at my friends house.

You don't really have a choice on where to send the forms. The ROC package is self explanatory and all the information is right there. Based on your location, you MUST send your completed application along with supporting documents to CSC. Don't worry about it being a place or a location. As long as the package is received and you get your extention(NOA), the rest is irrelevant. Also, you need to do something about your residential arrangement. If you are not residing with your spouse, and file jointly, then either you would be lying on the forms by giving the same address of residence or explaining why you are living apart. In both cases, you will be grilled by the USCIS. Good Luck!
