Hi, I just had my final divorce hearing today and I will be receiving my divorce decree in a couple days and I would like to send in my I-751 packet as soon as I get it. I current have my 2 year conditional card which will be expired May 12,2012.

The thing is I am waiting on certified court records from can for a petty juvenile charge but thats going to take a couple weeks. When I did the AOS I already submitted copies of these records. Question is should I submit the packet and put a letter stating I have included court records with my AOS and I'm currently waiting to recieve them now? or wait then submit it? I just want to get the packet in ASAP. Thanks

generally the advice is to send everything at once. an RFE would likely delay the approval slightly longer than waiting couple of weeks for the criminal records.

Hi! I believe if your 2-year Conditional GC expires on May 12, 2012, your 90-day window to file the I-751 starts on February 12, 2012 (the earliest date you can file - USCIS will send back your packet if you file too early). That means you have more time to wait for the documents you need. It might be better to wait to have everything you need so you can send a complete packet and reduce the chances of getting an RFE :) Hope that helps! ^_^

Thanks for the information but since I'm filed for a waiver I'm suppose to file A.S.A.P. but I have decided to wait until I receive my records. Thanks
