ok, it is said and written you can file for AOS if you are divorced and dont need any sponsorship. apparently UISCIS understands that sometimes marriages dont work out.

so my question is: What is th rate of succes of being approuved in that case?

what makes a AOS file successful eventhough divorced?

Are you sure you mean AOS? because you cant file AOS if you are divorced. You can file ROC = removal of conditions on your own if you are divorced.

Your chances of ROC are pretty good as long as you have evidence you entered into your marriage in good faith.

OUR TIMELINE

I am the USC, husband is adjusting from B2.

ADJUSTMENT OF STATUS

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved

01.13.2011 - Interview - no decision on the spot

ooops, you are RIGHT! I got all mixed up! :wacko:

ROC would be applying based on the marriage being in good faith. Having proof of that like joint bills etc, pretty much the same things had the marriage worked. Include the divorce decree and letter about it - if its a mutual agreement the former spouse could include a letter attesting the marriage was in good faith but just did not work out as well.

The removal of conditions section seems to have a fair a mount of successful posters who did it with divorce, iv only seen a few posts recently who had issues with their process but in the end did get their ROC granted anyways.

THank you, for this reply. atr least, i tis reassuring that they ask to tlak to the person to see what is legimate and what is a fraud.

mine is def. not a fraud, i have been betrayed.

but what are their criterias to consider that even though the marriage was one year long but apparenlty real one? an dgiven I havent anything wrong with the US gov, and been good, no arrest, nothing, not even a speed ticket, and worked part time and make a new family lately.

Do they appoved to remove conditions in those kind of cases?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Me and my ex file joint I-751 but after a couple of months or relationship fell apart and we end up divorce..so i have to cancel the first file and refile for I-751 waiver..I hire a lawyer to advise me and help me get through with this, because my case is complicated.But hiring a lawyer is worth every penny bcoz i was one of successful I-751 waiver for Removing condition. My advice is if you have a complicated case you really need to hire a lawyer. But if yoy think yours will be ok just trust your guts..Just submit all the evidence and info that your marriage from your ex are in good faith.and be your self on the interview.just answer what they only ask dont add more...Good luck..if u have question just ask me,im more than happy to asnwer it?

thank you a lot! Ok, so it is not hopeless...

I recieved a feed back that was so discouraging as if i was so the one to blame and blabla, but whatever! Now i am reassured, you can be btrayed, move on and still be ok with the uscis!

so my next uqestion is my ex husband is willing ot write a letter to certify about the events..

how does it called 'affidavit something' or 'something under penalty'.

can anyone light my candle about it..I cant see clear. and i can get some valid samples of that.

um. that's a pretty bitter-sounding statement.

you may want to look for advice in the 'effects of major family changes' forum as well.

many people file waivers for ROC because of divorce. i think you wont have an issue with getting your 10yr greencard.

read the instructions carefully and provide as much evidence as you can that supports the fact that you entered in to the marriage in good faith (affidavits can be good here. basically they are just letters that attest to the validity of the marriage and offer an honest explanation of why the marriage failed) and also any evidence that shows financial comingling. (joint taxes, joint health insurance, joknt bank accounts, mortagage or lease, etc)

ROC is easier than other parts of the immigration process. so i doubt you will need a lawyer as your case sounds pretty straight-forward.

just be organized and thorough and be prepared for a looooong wait.

well first of all, it is just because i try to avoid gary and alla replies, for the one he gave to me via PM was pretty awful,offending, and judgmental...and really I thought i was hopeless for i dared to divorce someone that lied to me.

so anyway! ;-) i like your little wink at the ned, you put a smile on my face.

second, I have prooves of a bonafide marriage, but i filed for divorced in April 2010, and the it has been settled in november, so that mnade only 14 months of marriage and, in January I was already leaving the house for it became unsafe for me.

I am just scared about the length..Things turnout to be wrong rather quickly, when you think about it. IS that something that can be seen like a problem for the uscis?

rthe usual ones,

health insurance, tax return ( only one, though..)

bank account, credit card. no mortgage for he owned the house prior my arrival.

maybe it is light... also, a car that he bought for me, with an affidavit from him that he bought it for me. and an affidavit from him to certify the good faith of marriage and and a chrono of things going wrong in time until the divorce.

Any thoughts?
