I have no idea if this is the correct forum...I just got back from Panama today and the customs officer guy asked me several, several questions about my travel, who I saw, why my fiance was denied, what visas have we tried for, ect..He told me that the best option for us is for me to go live in Panama for about a year, get married, then file a CR-1 visa for him to come over. He told me that even if a person is guilty of possession of marijuana, that is in a criminal court. When coming over here(if his waiver is granted), his case will go into an immigration court and that they consider anything over .5 grams intent to distribute. So, any chances of a person over that amount has a slim chance. If this is true, what is the point of being eligible for a waiver for less than 30 grams? Even if we did try a different visa, he would still have a criminal charge, so I don't even think that would work. The officer confused me so much and made me more depressed :( Can anyone clear things up, especially about this immigration court thing??

immigration court is in the usa.

yer fiance is in panama, not usa.

The Waiver, for a k-1 visa, is not done at any immigration court.

As to the CBP officer giving advice - don't fret - 10 times out of 10, they are wrong. Is different purview - they are CBP, not USCIS; even though all are under DHS.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

It was unsolicited advice, as well; if'n I'm reading what you wrote, properly.

Now - can you tell us? What issues do you foresee with your casefile?

Yes, I def wasn't asking him anything. He was drilling me for some reason and giving his input, making me feel worse. We filed the I-601 waiver. I'm afraid we won't get it. I don't think my hardships were too extreme. I don't have kids or major health issues. Plus, the fact his arrest dealt with drugs. It was way under the 30 grams (I think like 1.89), but still. I worry because my hardships aren't strong enough.

Hi there, we are somewhat in the same boat, but ours was over 18 years ago, we are in the stage of the NVC, they closed our case this past Friday so we are waiting for an interview, which might be anywhere from 3 to 4 months, as I'm looking at the timelines from our embassy.... my husband is getting even more nervous as this time goes is also very negative at this point, as to what they are going to say in the interview for the visa....grant it that we might qualify for it, but we are not looking forward to the outcome... Good luck, and as we all know that as this process goes through we have to have patience, patience, patience...
