length time for getting RFE???

Hii, i just got my NOA1 today via txt msg..but i think (i mean i am pretty sure) they will ask me for more evidence about my relationship or any passport stamps that we have met in withing 2 yrs..

my question is that how long would it be when i get my REF letter...because me and my fiance trying to meet in next month, but if the letter comes before tht time..i wont have any evidence for RFE. and also, if we meet now and send them these evidence, will they count?? or they dont count if we met after the petition? wont they think that i went there to meet him just because to get evidence?

You sent in a petition and you have not met your fiance? Then your petition will be denied. You need to have met within 2 years at the time you file the petition, not after.

no..i did met him within 2 yrs..but it was like i met him on dec 16th n i sent the petition on dec 12th..i got NOA1 20th(today)..

so i m just worried that they might ask for more evidence if they count 2 yrs as i got NOA1

i hears from lots of VJers that they take the date of from the stamps on my passport to NOA1 , which is 1 day more than 2 yrs...(the stamp is on dec 19th 2009..n NOA1 dec 20th 2011)

If you sent the petition Dec 12 and didn't meet until Dec 16, then you did not meet before you sent the petition.

Edit: Are you talking 2 years apart?

Of course they are going to ask for more evidence. It sounds like you had not met him when you filed your petition, which is against the main requirement of the petition.

petition was sent on dec 12th 2011

i got the NOA1 dec 20th 2011

i met my fiance dec 16th 2009(i didnt mentioned this in petition because i just send them a passport stamp)

passport stamps is dec 19th 2009in mumbai in india

so basically i filled the form n sent them 7 days before 2 yrs(193 day i think)

Are you trying to meet for the first time next month?

Oh, okay, I understand. You're cutting it close with the two year requirement then.

You should be okay. They will likely go by the date you filed your petition (the date you wrote on your forms) and not your NOA1 date.

Ok. Yeah cutting it a bit close.

Look through the timelines for K-1 petitions and you should be able to get a feel for when RFE's are issued. If you strongly suspect they will want further evidence start getting it together. I'd say you probably have 3 to 4 months before you see anything from them.

Hopefully it won't be an outright denial but I think you should make that "trying to meet next month" in to a "meeting next month" just to be safe.

You did not just meet for a single day back in 2009 did you--December 19th? You were in his country until the exit stamp in your pasport--right? When was that date? After the 20th of December? If not, then I would bet that they will deny the petition as you missed filing the petition within two year of having meet--the filing date is the date they accept it which is on the NOA1; not the post mark or the date you put on the forms. The USCIS returns ROC for being a single day early why would this be any different? If you can prove that you meet during your entire lenght of stay in 2009 and the is AFTER December 20th, 2009 then the petition will be accepted as it fullfils the meeting within two year requirement.

You Should definitely go to India to meet him, You are not just doing it for Visa, But you want to be with him. Do not worry about what could have been done. You can not change it. Going forward, keep all your boarding passes, tickets, hotel receipts, gift receipts, pictures. If just filed for your K1 and you just got your NOA1, then it is a long journey until you get RFE (If you get one). So do not worry about that right now. Just go and meet him and enjoy your time with him.
