After 3.5 years the DOS returned our case to the USCIS because it expired. It truly expired 3 years go because they are only valid for 4 months which is nonsense in the first place. From what I can read this is what happens when there is no real evidence to deny but no one really wants to say yes and grant the visa. Most likely I will have to start over. I did find reference to a Class Action Suit for just this kind of thing which I will be looking into.

Class Action Suit for K1 petitions

It is just inhumane to do this after all this time and processing.

I am sorry for all you have been through. You must have the patience of a saint. During this wait since May 2011 second interview what did you do? Did you contact congressmen or senator, did you have a lawyer? Did you tell the embassy you would file a writ of mandus? What finally made them decide to send it back now after all this time?

What will you do now? Marry? Move?

May God be with you.

I don't think I've seen anyone from this thread post about DNA stuff... may want to create a new topic under embassy and ask this question. Sorry I have no knowledge of what to do...

Also friends... I request you pray for us.. It's almost a year since our interview and dealing with AP... while I think I could continue to deal with AP on it's own but not when our daughter is facing brain surgery... The diagnosis came in and she has the original cyst in her head and it's softball size... but they found another more serious threat .. another cyst on her optical nerves putting much pressure behind her eyes. They have medicated her to reduce the swelling and I'm taking her to a neurosurgeon today to see what his treatment will be but I can only imagine that since its so serious he will choose surgery to either remove or drain this cyst. I'm very scared for her she wants papa adil here she wants us all beside her now.. I have faith that Allah will see us thru this but at the same time i really need my husband home to support and lean on in such a scary time.

Sorry to hear about your daughter. Inshallah everything will go fine. Our prayers are with you. I have sebaceous cysts on my head too. They are non threatening and even the doctor said if you operate on them another one might pop up somewhere else. Hopefully you will go through this tough time soon...

update on our daughter... the neurosurgeon discussed 3 different types of brain surgery but for the moment he didn't want to do anything because the risk of bleeding inside the brain is huge and that would cause more problems if he went in right away. He put her on a medication to reduce the swelling in her brain and she is still on two other pain meds for headache pain. the cyst is really large it takes up almost all the left side of her head and moves back into the back of her head. IF he can control the pain thru meds and she doesn't experience any vomiting or blurred vision then we have time to figure out the next steps slowly but due to the fact it's pressing her brain and on her optic nerves it could create a lot of problems. We have to watch her closely and its still possible that we will have to do surgery in the next month or two.. or hopefully wait a little longer until she's more stable.

I wish to GOD we could get the embassy to see how this is hurting our entire family how much my husband needs to be home and i wish we could send anything into the embassy to show the great medical need that our daughter has and they would show compassion and mercy and let him come home. I miss him terribly and had planned to see him in another few months for our 2nd anniversary but now, there is no way i will travel so far from my daughter when at any moment she could get worse.

congrats to FK for the passport request... good luck to you all.. sorry i haven't been here much just dealing with a lot and its so hard now to see that we are still stuck in the ap abyss...

EAbbas,

I can't fully express how sorry I am that you and your family are going through this. Maybe it's time to write a letter to the ambassador along with sending a letter from the doctor. It couldn't hurt your case and might get Adil here faster.

Thank you for the words of encouragement everybody... that means more to me than you can imagine right now...

We are going to contact my senator on Monday... we have received teh scans of my daughters cyst and it's very very large.. it is most of the left side of her head and wraps around to teh back and is also a large one in the back of her head. The Neurosurgeons don't want to operate right at the moment due to the swelling in her head so they ahve given her medication to lessen the swelling and she is still on two kinds of migraine medications but still has headaches with those. The danger is if they operate she may bleed out in the brain creating a bigger problem. However, if she can remain stable for a little while we can be very methodical in what to do next... we will have to do something as it is pressing on her optic nerves.

I have her medical records and about 10 views of the cyst so it's very easy to see even if you're not a doctor. It shows clearly the cyst pressing the brain to one side of her head and shows where their location is very clearly as well as the size of them.

I have no clue as to whether this will help us or not. The senator basically said it can't hurt to try and if it doesn't finish the AP then at least when we are finished the visa should be issued within a day or two of printing instead of several weeks later as sometimes happens.

Just wondering if anybody ever had any experience with this... I remember one of our members did with his wife's visa as he suffered health issues and got the Defense dpt involved but he was also military.

I don't want to jump ahead of anybody but if my daughter has this surgery and bleeds out... i'll be completely broken and without my husband here i can't imagine what I would be feeling.. i'm already depressed and struggling I can't watch my daughter suffer and not hold my husbands hand...

Dear ALLAH help us!!!
