Need help on expired green card

Hello everybody,

I´m not sure if I´m placing my question in the right category but I hope someone can help me. I searched for some answers on here already but couldnt find nothing similar.

I used to be permanent resident of the USA and I was supposed to removes condition in july this year. My husband and I split up in April and I went back to Germany. Because of that we didnt worry about the green card nomore. How it is in life sometimes, month later we got back together and now we trying to find out if there is anything we can do to my old green card like the I- 751 or if we have to do the whole process again?

Does anyone know if it will get harder for us this time to get a visa?

Hope anyone can help.

USCIS:

11/24/2008 : I-130 NOA1

01/13/2009 : Transfered to CSC

01/19/2009 : touched

01/30/2009 : APPROVED!!!!!!

02/05/2009 : NOA2 Hard copy in mail

NVC:

02/04/2009 : NVC case # assinged

02/09/2009 : DS3032 & AOS bill generated

02/11/2009 : DS3032 emailed

02/15/2009 : AOS Bill paid

02/17/2009 : DS3032 accepted

02/18/2009 : AOS Bill shown as PAID

02/21/2009 : IV Bill paid

02/24/2009 : IV Bill shown as PAID

02/26/2009 : DS230/I-864 sent

03/04/2009 : RFE

One simple thing you both have to understand that Your GC has been expired since July, you guys splitted and now rejoined. USCIS will definitely ask

you about the late submission of romoving of condition paperwork (if you are planning to send). If your marriage was come under good faith then you dont have to worry about it but of course it will put the bar and you will face little hassle of tackling questions from USCIS. I would suggest you dont do further

delays and if both of you are back together then act quickly and file for ROC (Removing of conditions). but again prepare yourself for answering USCIS about

delay of sending paperwork this late. Don't be discourage here asking questions. They say its never been too late so act wisely. I just sent away my paper

work like 3 days before the expiration of my GC. If you need further Info what to send drop lines here or there are alot others that can help you in what to

attach with ROC paperwork. USCIC rejects applications on fake marriages reason but I am sure they have some soft corners for those who entered with their

marriages in good faith but couldn't be able to apply on time...

I say file for the ROC any way and give the reasons why you did not file when you should have. You could have filed on your own even after the separation as long as your're able to show good intent/faith with the marriage.

You cannot enter the U.S. with your expired Green Card anymore. CBP will sweep it and tell you that because you failed to file for RoC half a year ago, your residency has been considered abandoned. They may be nice to you and "parole" you into the U.S. but you wouldn't be able to file for AoS, as you would not have been "admitted," totally ignoring that this would be immigration fraud.

You will have to start over. Look at it this way: you will receive a 10-year Green Card either way.

Thanks for the answeres and I also think we would have to do the process again which is no problem but does anyonoe know if it will get more complicated for us to do it over again? Will they make problems? Or it should be the same like the first time?
