Expiration of Visa

HI,

I'd like to ask a question about expiration of visa. I applied for I-130 for both my parents. I remember when I paid the visa last July that it's stated there that it's only valid for a year (when i paid online through travelvisas.gov.).

When they had medical last November, they find a scar on my mom's chest x-ray and was advised to have a sputum culture test and it will take 2 months for the result and if it's POSITIVE, it will take her 6 months treatment for tuberculosis. My dad, on the other hand, is advised to do a skin test and SLEC said that they will call the US Embassy to reschedule the interview.

From the timeline that I have, if she's positive, will it expire her visa and do I need to go back to square one for this OR the Embassy or National Visa Center extends the visa that I paid?

I'm positive that she will have a negative result, but I'm still wondering what if she got a positive result. I hope I could get response from this. Thank you!

She doesn't even have her visa yet so its not going to be expired. A visa has to be issued to have an expiration date. I think you are talking about the petition expiration! Generally the USEM extends the petition automatically.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I got confused with the expiration date. I guess it's the petition expiration. Thanks for replying. Have a good one :)

I don't know much about this type of visa. However, I'm thinking that since the visa won't be issued until the medical is completed, then there is no time issue. Visa clocks usually start ticking only after the medical is completed and/or the visa is issued. I don't think it matters when you paid for it. I hope others will chime in.

it's 130 that was approved. anyway, no need to reapply and pay again. before the expiration (say 3 months) request for extension citing your parents' extended required medical

Yup...no worries...the Embassy routinely extends active petitions. :thumbs:

Thanks Tahoma. That's good to know that they don't base it from the time I paid the visa. The medical exam in Manila is such a pain and I do get their point why they're so strict. I've asked my parents to do a medical exam before the actual petition began so I'd know if they have any medical issues, but I guess it's different from St. Luke's result.

I wasn't sure if they extend active petition. Thank you for replying. Good one!
