Expedite Request by Myself or through my Congresswoman

Hello. I am currently working with an immigration office here in my hometown. I had to find out on my own that I can ask for a expedite request. I have Multiple sclerosis and am asking the request based on medical reasons. My health is not doing so well and am working on getting the letter from my neurologist. My lawyer office said that they will take the letter to my area's congresswoman but I had also called the Customer Service center and filed a request and all I need to do is fax it to them directly. What should I do? Send it in myself or have my lawyer handle it. My fiance is in Mexico and the California Service has my application. He was caught and deported and I got my first NOA in August 15,2011. Any input would be great. Thank you.

Deported is an issue.

Not meaning to be cruel or dramatic, but needing a caregiver is typically not enough of a reason for expedite to be granted.

Also not meaning to be cruel, but my mom has had MS for almost 25 years. Some days are better than others with symptoms ranging from mild (lack of energy) to severe (having to use a walker or wheelchair for a while).

I'm not trying to minize your disease in any way, but I don't see a nuro-musclear disease as a path to an expedite.

In any event - I wish you the best of luck in your journey.

Yes he was caught. He was driving my sisters car -doing her a favor in fixing her car and the cop pulled him over. Determimed he was here illegally and called border patrol.

Not cruel. I don't need him to need a caregiver. I need him here for financial support and the everyday things. We also have a baby so we need him back home.

Congressman can't do anything to help the OP with the fiance's deportation (at least not right now). The I-129F still needs to be approved (either through the expedite that the OP is seeking or through normal processing), then the interview will need to take place in Mexico. Waiver will definitely be needed to get K-1 in hand.

Send it yourself, it is faster and a Congress person is more for when you are over processing times and such. But expedites are rarely granted for fiance visas (more often for spousal), and you have a weak case to start with, so don;t hold out too much hope.

Be aware that the financial issue may be a double edged sword and may end up working against you in the long run- as it costs a lot of money to have someone immigrate (especially when waivers will be needed such as in your case), and he would not be able to work for a few months after he gets to the USA, so be a drain on your resources, which the CO will consider when considering visa approval.

The beneficiary has been deported. This kind of case needs an attorney. The 601 waiver doesn't work for this kind of case BECAUSE of the deportation.

Agreed Pushbrk. I was just trying to be affectual with my wording to the OP. It looks pretty bleak. USCIS Guildlines were broken and now the parties need to come to bear with the outcome of their conduct. Yes, an Attorney is needed. I can't speculate the outcome. Alot of money is going to spent on an Attorney and maybe all in vein.

When I read the post. I said to myself: Well that just screwed-up everything. But I witheld my true thoughts. Penguin is correct as well: Write the letter yourself instead of paying a money hungry Attorney because I forsee NO IMMEDIATE AVAIL. I honestly think it will never happen. There I said it.. DAM

When you hire an attorney, it's best to follow their advice. Doing things against or outside their advice is never a good idea.

The OP hired an attorney, with whom they would have shared the details of their case, and whose advice they need to follow. There is a waiver to file in these situations and it needs to be filed by an attorney. Requesting an expedite is a simple procedure that may or may not succeed. It's an I-212 waiver, not an I-601. You don't wait for a visa denial to file this waiver and you DO go ahead and file a petition.

This is one of those cases where you simply don't know what you're talking about. Let the attorney advise their client.

A Waiver DOES NOT have to filed by an Attorney. An Expedite under the circumstances??? (edited)

(edited) They only filed a 129-F and have a NOA1. You can't add to a NOA1 or NOA2. They got Busted by USCIS before that. (edited)?

None of the above makes any sense. The waiver needed in this case can be and should be filed before the visa denial, so NOW, tomorrow or anytime, as opposed to an I-601 waiver that cannot be filed until after visa denial. This is a criminal matter, not an administrative proceeding. Leave it to the attorney.
