Can he still visit? Visa pending

So, my fiance had his visa interview on Nov 7th and was told that he needed to provide fingerprints from Australia. We have sent away for these to be processed, but are waiting, waiting, waiting. We are at the end of our rope as far as being apart goes and he is thinking about visiting in the next day or so (for Thanksgiving). I know he would need ties to his country to be allowed admittance. He was thinking about bringing his appoinmtment letter as well as the blue letter stating he needed to provide additional work - which he is working on - and also as proof that they have all of his original documentation (birth cert, divorce decree etc - who would walk away from that?!). He would also have his return ticket - for just 5-6 days of visiting. What else would he need to help him not be turned away?

He rented out his flat - so he doesn't have that.

He is living w/ his mother now b/c we thought he'd be ready to go after the interview.

He owns his own business, but he has shut it down except for one client.

Anything? Or will this be an automatic denial to the country? We will NOT get married while he's here - we just REALLY want to see each other.

Good luck with that! Most of the times when people ask a question like this you already know the answer. If he has a passport and visa to come to the US. there shouldn't be a problem. If he's just coming with a passport he'll be stopped. Why foolishly mess things up now when it sounds like you're almost at the end?

About the wait on the finger prints and police report, I do not know.

He can travel, the best thing is to be totally honest with CBP. Tell him to bring what ties to home he does have. A letter from his parents saying when he is expected to be back home is better than nothing. With that being said, have a back up plan in case he is denied entry.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks for merging - I posted it on the wrong board w/out realizing it - meant for it to be on the UK thread!! Thanks for fixing it.

I could go over there - and if we end up seeing each other that is probably what we will do - it just seems him flying here is cheaper than any flights I can find there.

Oh well, after looking it doesn't look like it'll work out. Was a nice thought for a second!

You cannot just make a blanket statement like this when it is not true.

Charlotte, my husband came to visit while we waited. He came here for Christmas week then went back to Scotland until Feb when he got the visa. He told the border agent that he had an interview scheduled and was not asked for the pending visa info. he did bring additional proof of ties to UK so they would not think he planned to stay but they never asked for it. If you are honest I think they will be reasonable. Uk is a Visa Waiver country for visitors. Since you can easily show that you have been following the proper steps and plan to wait for the visa to get married I really don't think he will have a problem. If you want to have Allan email David he said he would talk to him as he has been through it. it would be nice if you had some time together over the holidays. x

So he could not come with his passport and on the VWP program?

Or is it b/c he's on the last leg of the K1 visa that he wouldn't be able to apply for the VWP?

David came on the VWP half a dozen times while we waited. :)

If it doesn't work out maybe you can go there. I got reasonable last minute flight on KLM and Aer Lingus in the past.

If you are a UK citizen you are elligible to travel to the US on the VWP regardless of whether you are applying for a visa or not. There is nothing to say that you can't enter the US on the VWP while waiting for a visa. There is a chance you may be refused entry if the officer thinks there is a risk you plan to overstay but that is the same for everyone. If you have a return ticket and can show ties to the UK and are totally honest you shouldn't have a problem. I visited on a number of occasions while waiting for my visa. I brought evidence of ties every time but was never asked for it and had no problems.
