K1 status change

Hello VJ community,

My friend asked me a question,about a possible K1 visa status change. Since she's not a member on this site I told her I would asked the question for her:

O.k. here's what she needing help on.

My friend and her fiance decided that they will not go forward with getting marry "she's not ready". He have already completed the K1 visa and he was approved,(to come to the U.S on the K-1 visa) now that they aren't getting married he's concerned that he might not get to come to the U.S. at all now,because they didn't go forward with the "marriage" K1 visa.

By the way he's still in Jamaica...

Here's the question: Will he still be able to come/apply to the U.S. on another visa? "ex: visitor or work visa"? She doesn't wont to jeopardize his chances to come the U.S., she's willing to write both embassy (U.S./Jamaica) a letter explaining that its her fault not his on why they are getting married so he'll still have a chance to come to work/visit in the U.S.!! What steps they need to take about this?

I believe that she would need to withdraw her petition by writing a letter to USCIS and explaining the situation. If they change their minds about getting married in the future it shouldn't be a problem to re-file for a K-1 visa and withdrawing the K1 shouldn't have an impact on his chances of getting a tourist/work visa in the future.

Others may have more definitive answers but to my knowledge this isn't a huge issue. They might question them if they decided to file for a K1 at a later date but I'm sure if they explained the situation it wouldn't be a problem.

Your friend might also want to wait for a little while before she decides on withdrawing her petition. Her fiance has 6 months from the date of issue to come and she might change her mind. If it expires/is withdrawn they would have to start all over again from scratch....
