IS POSSIBLE ACCELERATE THE PROCESS?

Hello Guys!

Well, I would like some tips, words of support or even anything I can do to be as early as possible in the United States.

My case is a bit complicated (someone will say, "we all have problems and go through difficult times and want to be with our love." That is quite true ... if anyone says it, I'll understand perfectly. Of course I would love that my case be speeded up so that I had with my wife as soon as possible because I feel so much the lack of her and have been almost 6 months that we are far from each other.

But is not the "simple" fact of longing that I feel for her that makes me think to accelerate our process, but she is pregnant, exactly six months pregnant or 26 weeks of gestation to be more precise. I feel that I will not have my visa approved until February (the month that will give birth to our little girl) And then? how is this situation? She needs a lot of me next to her so I can assist her in these difficult times not only in the day to be born, but now with the pregnancy, doctors and many other things. It has been hard days, and of course we keep our faith and hope for a visa to come soon, but I have not even NOA2 and according to the VJ TIMELINE I'll just have NOA2 in January. It is quite complicated! I do not know how I would feel if my daughter was born and I can not stand next to her and beside my wife. It's not simply say to yourself "Oh, patience! Life is like that!" BECAUSE IT IS NOT LIKE THAT! Of course it affects us emotionally, that's simply the loss of a special date and VERY IMPORTANT. Who has children knows how it should be special and be there when born, must be an amazing and unique moment in someone's life.

All I want is to be there with her and our daughter, I do not care about the visa process, but this is not possible so far, for so much paperwork. But still I would like to do something to be there, I will not just sit and cross my arms like a loser!

If someone, by chance, suggesting a tourist visa ... I tell you that this is not possible because I will be visa denied.

Anyway, I would like help from someone who has had a case similar to ours!

I ask you comprehension.

Thank you!

cases may be expedited if they involve a serious financial loss, an

extreme emergency, a humanitarian situation, the request comes from a nonprofit organization advancing the cultural or social interests of the United States, it's a matter of national interest or security (the request must be made by a U.S. government official), or a USCIS error or compelling USCIS interest.

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

Severe financial loss to company or individual

Extreme emergent situation

Humanitarian situation

Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

USCIS error

Compelling interest of USCIS

It is very refreshing to hear such a young man care so much about being with his wife while she is pregnant. I commend you on being so responsible and for wanting to be there for the birth of your little girl. You get out of life what you have the courage to ask for. Realistically, there are hundreds that are walking in your shoes right now. I suggest that you ask for what you want respecting the answer you get, and then stay strong for your wife. This is a very stressful process and she will need your strength and positive attitude to get through this. The most important thing is that you do get the visa and that you do get to spend the rest of your life with your wife and child. May God Bless you.

If your girl has to take time off work after the baby is born, and you're not there ...

maybe you could prove severe financial hardship?

I think an expedite will probably not be approved. Hopefully you can get your approval in time. Maybe the government will start approving faster. Good luck!

I have read about a successful expedite at USCIS for a pregnancy. More than 1, actually - about 10 now in these last 2 years.

The USCitizen has to request it - you may or may not get approved. YMMV, greatly.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

We were able to expedite our case and I am pregnant (I am the USC petitioner). HOWEVER, our case involves urgent medical and family issues that go beyond a simple request to expedite only for pregnancy. Best of luck!!!

I am so sorry for you and your soon to be family. Unfortunately this is not a reason to expedite your case. My husband went back to Brazil voluntarily when our daughter was 6 months old, he is still in Brazil. He has been gone for over a year and left on an approved I 130 and had work authorization. It is a hard thing that we go through but god and love will see you through.

What other reason would be?

If the US petitioner is in the military and is to be deployed to combat areas. Not much else. Forget it. They don't care about the pregnancy. If the baby is born before your interview it will add +1 to the family size financial requirements.
