I-129F SENT BK FOR REVIEW, NOW MARRIED. BEST COURSE TO FOLLOW?

Hi everyone, it's been a while since I've posted a question. This is our dilema. My finance (now husband)was denied K-1 visa due to fact consular stated he was only filing for immigration purposes. They sent me an email stating that I could refile the I-129f or go to Nigeria and marry my fiance. On Sept 1, 2011 we were married!!

I was notified recently by email that the USCIS had received back our original I-129f for review. My question is this: Would it be in our best interest to wait for that petition to be reapproved first, before sending out I-130 petition?

Here is what I was going to do: File the I-130 sometime this month or next while waiting for the decision on the I-129f, letting them send that approved petition back to Lagos and set up another interview date. At that point I would formally request in writing to USCIS to withdraw the I-129f in favor of the I-130 keeping the interview date.

What are your thoughts fellow VJ's?

You have to withdraw the petition and file for CR1 visa- start all over. There's no sense of waiting for their decision, you are already married. If they approved your K-1 and finds out that you are already married, you'll have a problem.

You have to withdraw the petition and file for CR1 visa- start all over. There's no sense of waiting for their decision, you are already married. If they approved your K-1 and finds out that you are already married, you'll have a problem.

There's no use to wait for their decision because you already made your own move. Do you think you will you keep the same interview date that was suppose to be for K-1?

You can't transfer the date for a K1 that was reapproved to a CR1. You also could delay everything if they just declare the petition ezpired and then you have lost months. Write and withdrawl the K1 ( it is no good now that you are married) and file the I130 covering your relationship ( getting married is not an automatic approval if they already believe the relationship is for immigration benefits )

This will not be over quickly. You will not enjoy this.

My thought on this was that it would be good for the I-129f to be reaffirmed/reapproved to show no problem with that petition. Then to formally withdraw that petition because we are now married and will be filing the I-130. My husband will file a CV-1 when the I-130 is approved and forwarded to Lagos.

The K-1 has already expired. Yes we are well aware that just because we have married is not quarantee that Lagos will not say its for immigration purposes. In the meantime we are gathering as much evidence as possible to send in with our I-130 petition.

I really don't want to withdraw the I-129f until its been reapproved. I just don't know it it matters whether or not its withdrawn before the approval.

As for the reason K-1 was denied, well that will be addressed in the I-130 by front loading the petition with correct evidence this time around.

My mom and my husband are now emailing one another since he finally has a computer. It is so cute to read their exchanges as my husband is learning how to type and use the computer at the same time. Mom has really come through for us and I know that will have a favorable affect on the petition. We now have a better idea as to what Lagos is looking for and hopefully will have addressed all of the areas of concern.

How are you progressing with your petition? Have you sent out the I-130 yet? I'm still waiting for phone records from Tracphone and my husband is trying to obtain records from his carrier. Hopefully I will have everything ready for the end of this month or early December.

If the K1 has expired then go ahead and file for the I130 petition you will be approved quickly, it takes 4-5 months.

You cannot attend an interview for a K1 petition when you are already married.

We are NOT trying to misrepresent anything. We want to do this in the best possible way for a favorable outcome and to do it HONESTLY. I don't recall ever receiving a post from you. Sorry.
