Timeline

I was trying to bring my fiance from Ethiopia with a K-1 visa but denied a year ago, now I am planning to bring him with a marriage visa. I am going to Ethiopian this week to get married but I dont know which process I should follow, K-3 or, ICR-1. the other thing is since he was denied before in K-1 visa, is the process going to be possible or complicated? I dont have a clue which way to proceed, any help would be appreciated.

You should file for the CR-1, that's form I-130. And yes it will be a little complicated, you should let them know about the denial however .

The Consular Section in Addis will not accept I-130 petitions from American Citizens who have resided in Ethiopia. They stop doing that. Please visit the American Citizen Service window for more details in Addis Ababa, Ethiopia.

Marriage Information: Consular officer issues a free to marry document for a U.S. Citizen or a legal permanent resident. Than the Ethiopian Ministry of Foreign Affairs should authenticate the document so that the local municipality office accepts the free to marry document. call: 215-11-1562394 Application form for marriage certificate

what is NOIR?

Notice of Intent to Revoke, if USCIS agrees with the decision by the Embassy/Consulate to refuse a visa, they send the petitioner an NOIR. As NigeriaorBust alluded to, a petitioner that receives an NOIR must submit a rebuttal to it or a mark of misrepresentation gets placed on the beneficiary.

What I will give u in here is from my experience it is not a professional advise based legal bases.

First make the marriage when you reach Addis ababa, in making the marriage, you have many options that you can be legally married in Ethiopia dependening your religions and other believes.

1. Through the Churches....Stamped by the mininstry of justice, then Authenticated by the ministry of Foreign AFffairs (legal and legit)

2. Through the Federal Sharia courts... Stamped by the ministry of justice, then Authenticated by the ministry of Foreign AFFairs ( legal and legit)

3. Through the Kebele "the city Adminstration" Stamped by the ministry of justice, then Authenticated by the ministry of Foreign AFFairs ( legal and legit)

4. Throught The American Embassy .... stamped by the ministry of justice, then Authenticated by the ministry of Foreign Affairs ( legal and legit)

I would recommend through the Kebele, it is cheaper less hastle and more governmental and the NVC center has its sample as a guidance,but accepts all the others, when i am saying this, because i went through the federal sharia courts and I had to answer some questions, if not go through the American embassy, it is the most expensive one but worth the price at the end.

Make sure you take pictures when you are making the marriage certificate, becuase picture might help you that you together in the whole process and can set a historical trend of your life together. photos photos photos every where you guys go while there.

When you come back to the stays, then you will file i-130.

1. Marriage of certificate

2. 2 photos of her

3. i-130 form

4. 350$ if i am not mistaken

5. your passaport, showing exit, and entry of Ethiopia

6..........some extra others add them up to the list
