Questions regarding the K1 Fiance Visa Process

Hello all. I have some questions regarding the K1visa application process.

1. Once I submit the K1visa how long until I know it will be approved? I am asking a time period?

2. Once approved what is the next step?

3. I am the american us citizen do i get the medical exam too and what are the costs?

4. usually how long does the process take for my fiance living overseas to recieve his interview and visa?

Does he take all the documents I submitted to the interview?

Also, do I do the interview or is it only for the foreign fiance?

5. Once my fiance gets to america and we get married how does he apply for the green card and how long does it take?

Since we have 3 months to get married and he applies for his green card during this point.

6. Regarding financial things since he is new to the country will banks give out loans, what are options for health insurance if anyone with experience knows.

7. Do they ask for proof of funds money for myself and fiance? What does this mean and what do they ask for?

I am going to submit everything next week.

Any answers will be so helpful.

K I don't know all the answers but I'll help out with what I do know :)

1) it varies, your looking at a few months no matter what however

3) I don't think so, I think its just the fiance, though I don't know how much it costs since it probably also varies by country.

4) a few months, depends on the country and how backlogged they are.

yes you should make a copy of the entire packet for your fiance, including the check or money order.

for the k1 visa only the fiance gets interviewed, but you'll have an interview with them for the green card (I think).

7) Yes its an affidant of support, you fill it out and it gets looked at right before the interview. You need to make 125% of the baseline poverty level for the # of people in your household (who are your dependents, if you just have him and you and no kids then that is a household of 2) he cannot help you with this #, it has to be you alone, or you can get a cosponsor like a parent etc that is an american as well.

Welcome to VJ. We're here to help you before, during and after your fiance's visa, but you also have to do your part by reading the guides posted here on VJ.

1) You are NOT submitting the K-1 visa, you are submitting the I-129F PETITION to USCIS for approval. Once you receive that your fiance will interview for the K-1 visa at the Embassy in the country they live. The I-129F petition takes 3-6+ months for approval, then you have the embassy interview wait whih varies by Embassy. Some are only a few weeks, others are months out for appointments.

2) Once you are approved for what? The I-129F petition? Your fiance's K-1? You gotta be a bit more specific please.

3) The USC does not take the physical - your beneficiary does at doctors approved by the Embassy before the interview. Medical costs vary depending on the country from $200-$300+. It can be more if your fiance needs vaccinations and they are performed by the panel physician.

Actually, I need to quit here. I am not trying to insult you in any manner but this is YOUR petition, not ours. It is apparent that you haven't even tried to learn anything about this process by either researching the USCIS.gov website or simply by reading the various guides and/or searching the 1,000's of posts in this very forum. I know the process can be confusing and daunting but not so much if you take the time do your basic research here.

I hope you will heed my words and learn about this. It is not difficult if you put some time and effort into the process. Then if you have questions AFTER reading through VJ we're here to help...

1. Depends. Wait time was 3 months, then it was 5 months, then it was quicker again...

2. Once the petition is approved then the file is sent to his countries consulate for him to submit paperwork to apply for the visa.

3. No.

4. Depends on the country. Provide country and you can get more specific answers. For example, Australia is quick. You'd be looking at around 3 months or less from NOA2 to interview, many other countries are slower.

5. He must apply for his adjustment of status (AOS). He must marry you in the 90 days to AOS based on the K1. It costs $1070 at the moment, will probably go up again before he gets his visa. That process is more paperwork, possibly another interview and then 2 years later removal of conditions (ROC). Yet more money and paperwork.

6. No. He has ZERO credit history. I got a capital one credit card to start building my credit history. I paid $50 or thereabouts for a $200 limit. Secured card was all someone like me, with no history, could get. Health insurance I get through my husbands work, so no idea there.

7. They want proof of funds from you at the interview stage of the K1. (so not until he gets the paperwork in his home country). The form is I-134 (though again depending on country you could need the I-864). For a household size of 2 (assuming no kids and just you and him) you need an annual income of $18,387. Again, could change slightly by the time you apply.

**Note: Fee wise you have the 340 fee for the K1 petition, the cost of the medical, cost of shots (if required for his country, mine was $400 for the medical + shots), police check (mine was $120) and the visa application fee of USD$350 (converted to whatever currency of his home country at the exchange rate at the time of interview).

If you spend some time looking at everyone's timelines, you'll see that they vary. Also, a helpful forum is your country's forum (or your fiance's country) because you can chat with people there about embassy processing times etc. You should be able to get all the help you need here. In theory, fiance can visit, but there is no guarantee of admission into the country, even if a visa has been given. Most people here seems to avoid the risk. For what is worth, many here have reported that had no problems, and the majority has been from the EU countries, recently someone from a Scandinavian country reported being denied admission.

It would seem that countries not in the EU have much more denial rate, but has not been reported.

We (fiancee and I) choose to meet in a 3rd country to avoid any risks.

Yes, technically the fiance can visit. All you need to bring is proof of ties to the home country (beneficiary does that is) and that is also in the FAQ section of the K-1. If your fiance does get denied, its not a problem. It will not have any bearing on your K-1 as long as you are telling the truth and don't try and do it so you can marry faster. trust me, I know from experience....JUst make sure the beneficiary can prove they are returning to home country and you should be ok. What country is beneficiary from? that could have bearing on how easy or difficult it could be as well. Hope this helps :)

Just to add something to the good answers you've received so far. Capital One has a credit card called "for newcomers (to the US)". I applied to that and received an initial credit line of $300. No down payments or deposits required. Before that, I had tried with the banks where we have an account (and have a direct deposit from our jobs), but both rejected me for insufficient credit history. $300 is not much (in fact, you're done using it after buying gas twice, going out for dinner and getting groceries a couple of times), but I already received a letter saying that they will extend it to $500 in the next months.
