Canadian Nurse marrying American Realtor HELP!!!!!!!!

Hello All,

I am a Canadian Nurse, and I am planning on marry my American Fiancee. I want to get this process right so we do not run into any trouble. So here is our situation

1) We are getting married in December 2011

2) He wants to become a Canadian permanent resident first

3) I want to get my green card after

my questions are

1) How should I go about this process, how long after we get married should I sponsor him to Canada

2) How long after we get married before I file for the K3 visa for the US.

3) Will it be problematic if I get my green card but DO NOT live in the US and have a job in Canada that I need to tend to?

4) Do I have to "inform" the US consulate when I marry my fiancee and befor I sponsor him? Like do THEY need to know before I apply the K3 to avoid future trouble?

I have a permanent job and can show that I need to come back to work, but my fiancee is self-employed so it's hard to show "attachments" that he has to the US, will this be a problem anytime during our application processes??

I can't answer your Canadian questions, but you should only file for the K3 (actually, file for the CR-1 which is better- the K3 is obsolete) when you are ready to move to the USA. The greencard is for Legal Permanent Residents, and you will need to reside inside the USA, spending more time inside the US than outside. The process tales about a year once you file and then you have 6 months to use the visa.

You do not need to inform the consulate of your marriage. But never lie, so when you visit the US after your wedding and they ask at the border if you are married or similar, tell the truth.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Can_nurse, are you working in Canada or US? (not trivial--there are lots of Canuck nurses who do work in US)

That can make substantial difference to your GC process in the US (it may be much cheaper to do AOS from a pre-exisiting work visa).

There are a few forums for immigrating to Canada. I know I've seen people on this board recommending one called Road to Canada (roadtocanada.com), they would be much more knowledgeable with regards to the Canada side of things.

It sounds like you want to start out in Canada first so I would concentrate your research there. I would look into dual-citizenship for your husband because I am thinking that he would lose his Permanent Resident status if you guys moved down to the US when you were trying to get your legal status in the US. I am just guessing here, I haven't looked at Canadian immigration because I will be moving down south to be with my guy.

As Penguin said when you are ready to move to the US, you would file for a CR-1/IR-1 Visa (depending on how long you've been married when you apply)to become a LPR of the US. But, you have to maintain residency in the US, so you can't just have a green card and live/work in Canada. It will take about a year to get your Visa to move to the US and then 3 years after entering to naturalize.

I suggest you refactor your plan for any K-3 visa.
