A situation with K1 interview: Advice needed.

Hey folks,

I received the date for my interview at the embassy but I have a problem due to an issue that has arose. I spent more than a year in malaysia after my 16th birthday which has meant that I need to get a police certificate from them. I have filled in all the necessary paperwork and they seem to be taking their sweet time with the process.

Now, the situation that has arisen is down to the time frames that were given to me about processing times for interview. I was told 6-8 weeks then 2-3 weeks after that would be the actual date day of interview. Due to these time frames, I sent in the DS2001 saying that I am ready for interview. As things have turned out, the date for interview is less than 4 weeks and I am still waiting on the paperwork from malaysia, despite the fact that I requested the police cert back at the beginning of september.

It is highly likely that it may come between now and the date of interview but what happens in the event it doesnt? Is it going to matter? I have absolutely everything else going apart from this one bit of paper. Should I postpone?

Need advice please.

You could either postpone the interview or go without the certificate. I *believe* (but could be very wrong) that if everything else goes okay they would just delay approval until they get the certificate (kind of like people who interview before they have their medical).

Your best option would be to call or email the embassy and ask them what you should do.

Just go to the interview & explain the police cert will be coming. They will withold the actual visa until you provide the police cert. If you postpone you may have to wait a long time to get another date.

They may not even ask for it at the interview. If they do, tell them you're still waiting on it. Then when you get it, the embassy will send a courier over to your house to pick it up and you'll be approved a couple weeks or so later. No need to go back to the embassy. But don't lose hope, it may still come in time!

Thank you for all the above folks. That is much appreciated and it helps me decide what I will now do. I will just wait and then tell them I dont have it if by the interview date I dont have it.

It may very well not even be asked for because most of the stories that I have read about people having interviews at the London Embassy they have to provide very little in terms of, once they get to the window to talk to the person about the visa their information isnt really looked at.

So lets hope that is the case if i have to not have it on the day of interview haha

Ha, the Malaysian authorities can be pretty slow when it comes to stuff like this... :whistle: (Not jeering you, OP, but at the Malaysian authorities!)

Anyway, if I remember correctly, it took me about two months to get my Letter of Good Conduct from the Malaysian Ministry of Foreign Affairs. If you sent in your paperwork in early-September, I think you may get yours in early-November... but don't quote me on that.

Write me a PM if you still haven't gotten it by then, and I will try to get you an email for you to write to, regarding the paperwork.

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.

Yes. Contact the consulate and postpone until you have ALL documents you need IN YOUR HAND

If you do delay an interview is it a case of being able to delay it a couple of weeks or do you go to the back of queue for an interview date again?

There is an update to this situation.

I sent all the paperwork on the 6th september and I have called the Malaysian High Commission more times that I care to count and have been ringing the consular department in malaysia itself. I finally got through to a consular representative last night and they have no paperwork for me at all. Despite the HC in london telling me they have sent the paperwork, my payment and the copies of the passport pages to malaysia.

The interview is on the 22nd november and there is no way that I am going to have it in place if ever by the sounds of it. I was in boarding school from the age of 16 to just before my 18th birthday in malaysia, which is why I am trying to get this paperwork. The embassy want police checks for anywhere you spent more than a year after your 16th birthday.

What do I do in the event where I cant even get the paperwork?

I cannot do more than what I have already been doing apart from physically flying over there and tring to deal with it which is rediculous and I couldnt afford it anyway!

I think you need to go to the interview anyway. Bring what you have. When they ask about the documents you are trying to obtain just explain what you have been doing. If you have any documentation to prove you are in the process of obtaining the police certs I would bring that. Most likely they will give you an RFE to come back once you have the needed documents.

Granted all embassies are different but we had an incorrect police certificate during our interview and they told us to get the new one and just come back once we had it. (We didn't need a new interview date we just showed our 221g at the gate). We were approved right after showing them the new police cert.

Best of luck. I think this will only be a slight delay as long as you can figure out the Malaysian end.

I am definitely going to go to the interview regardless. If I cant get paperwork then I cant get paperwork, surely I wont be punished for that. IE, no visa etc. I would hope that an RFE is the worst part but then I may never get the paperwork so what happens in that regard? lol

This is just something that is creating unnecessary stress and getting very annoying.

Because Malaysia is on the list of countries with obtainable police certifcates Travel.state.gov docs for Malaysia I don't think you should assume that you won't have to get it. I would bring as much documentation as you can to your interview to show you have been trying to get the certificate as well as any response you have from the Malaysian authorities.

Malaysian girl seemed to think you might just have to wait a little bit longer. Have you contacted your own embassy in Malaysia to see if they can help you get it?

Good luck! I know it isn't fun but you're getting close to the end...at least until AOS :P

I am a British and I have done everything I can to try and get the certificate and now they are just messing me around. I have been calling nearly everyday atm to try and chase up the paperwork and they arent even interested. I am not even on the system in malaysia apparently despite the fact that the Malaysian Embassy in London said they forwarded the information. They still apparently, via the e-consular site that you apply through, havent received the supporting documents but the embassy in london told me they sent the supporting documents weeks ago.

Everytime I phone malaysia either the person im trying to get in touch with isnt there so I get put through to someone else and the last convo I had was that they had no details whatsoever. I have been chasing up the people in London because they are the ones that I sent my info too and whenever I try and ring they are either away, having a day off or doing whatever.

I have completed everything I possibly can and I have everything else. If I dont get the visa because of piece of paperwork I am going to literally flip out. It wont achieve anything but I am getting bored of remaining calm and trying to remain understanding and patient. I sent all the paperwork on the 6th september and since than I have put up with all the BS and sent in the copies of the pages of my passport etc that they requested and still nothing. The process is meant to take 1-2 months and we are now basically on 3 months now and the consular department that needs to update the e-consular site is claiming they dont even have my info.

So at this stage, I no longer have any idea what to do in terms of how I go about trying to secure this paperwork.

On a side note I dont want to ring the embassy and ask them about it because I dont want to highlight the fact that I am struggling to get some of the paperwork. I have documented what I have done thus far to try and get the necessary paperwork which I will provide the embassy upon request.

It is just completely stressing me out now and I am a little bit antsy about the whole thing given that this could delay or cause the visa to be denied.
