I-134 - Co-sponsor Questions

Timeline

I will be using either my mom or dad as a co-sponsor, and I have some questions.

1.) My parents file their taxes jointly. Does this affect anything?

2.) Does it matter if I'm listed as a dependent on my parent's taxes? Will that affect the decision at all?

3.) When marking people as dependent or partially dependent on the I-134, what do you put for a spouse? What would my mom put my dad as? Would my dad be considered a dependent even though he has his own job and income? Because right now my mom would have to meet a household size of 5 poverty level requirement on her own as a co-sponsor, when in fact the household has plenty of other income.

Timeline

For the I-134 it is a sponsor's individual income that is used. No combining of incomes. Either mom or dad is the co/joint sponsor.

If your parents claimed you as a dependent on their 2010 tax return then you are included in their household count.

The household count for either parent includes each of them, any minor children, any person claimed as dependents, plus the intending immigrant.

Does me being a dependent affect anything though? Even though I have a co-sponsor who meets the requirements, could they reject it just because they think I can't provide for myself?

Also, what about what my mom should write on the I-134? Should she list my dad as a dependent even though he has a stable income of his own?

Why would they up the needed household poverty level without taking into account the income of the other household members? Why would my dad count as part of the household size my mom has to support when he makes enough money on his own.

Being a dependent will not impact the visa approval.

The affidavit is an individual form. The form I-134 does not allow for combining of incomes.

Sorry to be a handful here, but I still need to know if my mom has to write my dad on the I-134. I know they won't combine the incomes, but I need to know if she has to write him in the "Dependents" box. And if so, would he be wholly, or partially dependent?

In regards to the combined incomes, I was more just wondering why they have the "household size" set up the way they do. It doesn't make much sense to me why the co-sponsor has to support a spouse that can support themselves.

Hi everyone!

I'm in a similar boat. I am currently unemployed, and about to send in the 1-129F and everything else (just starting this whole process!) Do I need to include the I-134 (my dad will co-sponsor me) or is that only needed down the road?
