Nothing to be afraid of CR1, as long as your documents are complete and No RFE you will be done in less than 10 months. I have many friends who got their visa within 7 months..It's CR1 and some are IR1. Get the marriage certificate and go for CR1 if possible. God bless.

Just file for the I-130 because it is faster in the long run. Why do you want to do the K visas for? It is better to get the correct documents together and do it the spouse way. I had considered all three options and opted for the I-130 because it seemed to be a timesaver so he would already have a greencard and be able to work right away. So, why not just do that I-130 so that he can work when he gets here? Also, you wont have to go through all that paperwork to adjust status. Then you will just need to remove the conditions on the two year greencard later on which would be better in my opinion. You may want to get some legal advice about the validity of your marriage in accordance with Indian law. My cousin lives in Kerala and as per my knowledge if you married at all, be it small or large, then you'd be considered married.

Are you both of Indian origin?

Did you meet on a wedding website? Or was it a dating site?

Do you both belong to the same religion?

If by small ceremony, you mean fire, priest and mangalsutra--you're married in the eyes of our multiple Hindu gods and goddesses and Indian law. You should have your husband obtain a marriage certificate and start preparing for the CR-1. If you're well prepared, you can go through the CR-1 process in 8 months or so. Do NOT do anything as foolish as lying to the US government about your marriage ceremony.

Personal opinion: I find it terribly odd when people talk about how they can't live without the other person given that they've known them for a few months and met only once in real life. You'll survive a few months apart. We all did.

IMHO, regardless if it is not yet filed, of course you were married. Ask your husband to file paperworks for you. then when all documents ready, file for CR1. i do not think that CR1 process will take years- it may take 9-12 months (not unless if there are other setbacks)... just be patient with all the processes and you will soon get there..

Hi Everyone,

Thank you very much for taking the time to reply me with your suggestions. I am glad for your guidance. I am now gathering all the evidences,records, emails, chats, phone records, photos, airline ticket, statements from both sides of the family members, and every possible proof to prove this as a genuine marriage. Please remember, if you are pursuing a K-3 -

that it's TWO sets of evidence - one for the I-130, another for the I-129F -

each is evaluated/adjudicated on it's own.

So something you included for the I-130 usually isn't looked at when the I-129F is reviewed/evaluated/adjudicated unless you've included another 'set' of the same thing with the I-129F.

IMO, it's dual work.

Also, IMO, you've scant hope of actually keeping the K-3 path open till it's completion at the Embassy IV Unit - USUALLY NVC will 'administratively close' the I-129F when it travels together with the I-130. And usually, an approved I-129F travels together out of USCIS into NVC along with an approved I-130.

It's a scant hope, but still a hope, regardless. Be prepared mentally and emotionally for it to be closed, for the CR-1 path to 'go forth' at NVC.
