Prior Marriages Question...

So the embassy website says this:

Termination of Prior Marriages: Married applicants must obtain an original marriage certificate, or a certified copy, bearing the appropriate seal or stamp of the issuing authority.

This does not make sense to me - he is not married, and hasn't been for 10 years. He has his divorce decree, but I am almost 100% sure he does not have his marriage certificate. Is this going to be a problem!?!?

A married person submits submits a marriage certificate.

A single person who has been divorced submits divorce decrees.

A person presently married who has been divorced in the past would submit evidence of both (current marriage and past divorce decree(s).

Great - so just the divorce decree...phew!! I was about to lose it! We have had everything ready for so long, but after looking on the embassy website and reading that made me nervous! We are too close to the interview date to request a marriage certificate to prove he was married...but we have the divorce decree....lol okay - I'm settled! Thanks!

Not sure if this is any help, but to be on the safe side I ordered a certified copy of my marriage certificate anyway (married in 1995, divorced 99) and managed to get it on next day delivery here in the U.K from the GRO website. It cost £26 and was worth the peace of mind for me. I would advise its perhaps best to call the embassy and double check if you are at all worried. Chances are, a divorce decree alone will be fine, but after all this waiting, I'm taking NO chances ;)

My husband did not provide his marriage certificate for his prior marriage. Other people have verified the same thing with London.

But.....

Their website has some problems and inconsistencies. (I've even written them, pointing things out but got no reply.) They currently have two different pages listing documents. Notice this first one (link from K1 page) looks like they did a copy/paste but picked up the wrong section. The termination of prior marriages is a repeat of the one above it---

That seems clear that it is only married applicants who provide a marriage certificate. But the list below actually has slightly different information:

Divorce Decree or Death Certificate:
Applicants who have previously been married should be prepared to submit evidence of the termination of the marriage (i.e. divorce decree or death certificate). Original documents or certified copies are acceptable.

It's a little confusing. (And they need to fix their webpages!) ,

After a bit of searching on the embassy website - I found this too. I decided to just relax and go with, we didn't need one - because, if you had a divorce decree, obviously you were married to the person you are divorcing. Shouldn't that be proof enough!

I'm glad that somebody else has found the website inconsistent though - I though t perhaps it was just the way I was reading it.

Also, VERY good news to hear about others in that situation making it through just fine without the certificate of marriage, just the divorce decree!! Very calming!

As always, thanks Nich-Nick!!! With all of your help and insight I feel like I will owe you a bottle of wine or some other token of gratitude by the end of all of this!!! ;)
